Fact 1: |
The U.S. Attorney, acting on behalf of the Lummi Tribe, is suing six Lot Owners on West Beach for trespass and other violations of Federal Law. The trial of The Six will take place in Seattle, in February 2003. |
Fact 2: |
The Federal Judge hearing the case, Barbara Rothstein, has stated that all lot owners at Sandy Point will be held to the results of the trial. |
Fact 3: |
The Tribe has given the U.S. Attorney a list of the next 50 Lot Owners to be sued. Neptune Beach, Lummi Bay and West Beach lots are included in the 50. |
Fact 4: |
In the trial of the Six, the Tribe is claiming ownership of all land less than 12 ft. in elevation. If the Tribe is successful in this assertion, most of the lot owners on Sandy Point will forfeit their land to the Tribe. Refer to the FEMA elevation map for the status of your property. You can obtain a FEMA map from any SPA Board member. |

Our chances of winning this case are good if we can pay the legal fees. |
Fact 6: |
If you contribute to the Legal Defense Fund, you will have the benefit of all legal and expert witness resources funded by SPA. If you choose not to contribute to the fund, you will be on your own if attacked by the Tribe and U.S. Attorney. |
