Alki Art Fair Use Agreement

 

This agreement made and entered into this _____ day of ____________, 2009, by Alki Community Center and Advisory Council and Seattle Department of Parks and Recreation; hereinafter referred to as the “AAC” and (please print):

Hereinafter referred to as the “USER “set forth terms and conditions of the use of space at Alki Beach Park as follows:

 

1.      AAC grants the USER space at Alki Beach Park for the purpose of selling arts, crafts, etc during the Alki Art Fair.

 

2.      Term:  The term of this agreement shall be for two days commencing at 8:00am – 7:00pm on July 25, and July 26, 2009.

 

3.      Consideration:  The USER promises and agrees to pay in advance $110.00 per booth space to the AAC at the time of application.  In addition, AAC will require a financial statement and payment 10% of gross revenues.  The financial statement and payment must be given to the one of the Event Coordinators following the event, or sent to the Alki Community Center ten (10) business days following the event.  Checks payable to:  City of Seattle.  User is responsible for all applicable sales tax.

 

4.      Management and Control:  There is hereby expressly reserved to AAC the right to make rules, regulations, and requirement relating to the management of all premises occupied by and used by the USER to comply with such rules, regulations, and requirements now existing or hereafter or to be made, or violation by the USER of any Ordinance of the City of Seattle or of any law of the State of Washington, shall be sufficient ground for termination by AAC of the agreement and of all rights of the USER therein or thereunder:  and there is hereby expressly reserved to the AAC the right and power to so terminate the same prior to expiration of the term herein above specified upon any of the grounds herein provided; and USER hereby expressly waives the right to claim or recover any damages on account of such termination against said  AAC, City of Seattle, staff, volunteers, employees, their agents, and executors.

 

5.      USER agrees that no liquor, drugs, guns, firearms, food, combustible items, slot machines, or gambling devices of any kind shall be allowed in or about the assigned premises.  The USER shall not permit lewd or immoral conduct on the assigned premises.

 

6.      Assignment of Agreement:  It is further stipulated and agreed that neither this Agreement nor any rights or privileges thereunder shall be assigned by the USER without the consent in writing of SWCC having been first obtained.

 

7.      The USER agrees to provide necessary supplies to ensure no physical damage occurs to Alki Beach Park.  USER agrees to remove all unsold items out of the area and off the grounds at the conclusion of the sale.  No unsold items will be allowed in the dumpster.

 

8.      Surrender of Premises: At the expiration of the term of this Agreement, or upon prior termination thereof. In the manner or any of the causes therein provided, occupied or used by the USER hereunder, without any right or claim to reimbursement, or compensation of any kind.

 

9.      We are not responsible for lost, stolen, or damaged valuables.
