They find Mr Kendall there, very much alive.

What's Really Going on Chris?

It's the morning after. Maddie and David wake up in Maddie's bed. We find out they didn't sleep much, but enjoyed themselves immensely. David asks her to drop him by his place, but she claims she can't because she has an appointment. He takes a cab back home. Agnes tells Maddie when she comes in that "I don't know what it is, but you look great!" This irritates Maddie. David comes in singing. Maddie is upset that he came in singing, worried what the employees will think. Dave says it'll look, "like every other day when I come in singing." They both admit to feeling weird and awkward. David says that it is OK that they'll work it out, but Maddie wants to forget it. She says last night was a mistake, it wasn't supposed to happen and it makes everything wrong. She claims that she got caught up in the moment before she could think. David buys this for the first time, but not the second. She suggests that they make a pact that last night never happened. David doesn't want to make a pact. She asks him if he remembers what he said last night and he says yes. She tells him that if he meant it, he'll make the pact.
Later, Maddie goes to David's office to update him on the case. He tells her he didn't get anything done, everything from the night before was catching up with him. He then tells Maddie he didn't go anywhere or do anything (his way of telling her he will agree to the pact.) David leaves to talk to Robert Murphy. That night David talks to Margaret at the police station. Maddie shows up to help and drives David home. He tells her that he didn't call her to get her out in the middle of the night trying to 'pull' something. She tell him that she doesn't think that at all and understands how unfair this seems and how hard this is for him, but still thinks it's the right thing to do. He admits it's very hard and starts discussing some of the places he'd like to kiss her. They both appear to get 'hot and bothered' by this discussion but agree that that's why they have the pact. They look at each other but can't take it any longer, they start kissing and end up in David's bed.
After they're done, Maddie suggests they make a new pact since what they just did "invalidates the old one." David thinks she's nuts. She says she doesn't understands why this keeps happening because she keeps vowing it will never happen again. She doesn't just give herself to people, she thinks about it, and when she does it not all wild and frenzied like this. David doesn't understand why she is so upset. He asks if it's about work and offers to find a new job. She says that's not it, they don't make sense and David isn't who she is supposed to be with. David doesn't understand, but Maddie says that is because Maddie is exactly who he wants to be with. She tells him they are an affair, and she doesn't have affairs. David says that that's OK, but Maddie says it's not. David asks why can't she go with something that's good for right now. She gets upset and asks him if that's all she is to him. She tells him that she knows it's not and that he is crazy about her and will be for a long time. He denies this and says the only reason he did any of it was to 'save' her from marrying Sam. Maddie doesn't believe it and David tells her he can't help it if women believe anything you tell them if you tell you them you love them first. They argue about whether David is lying when they are interrupted by the phone.
On the way to the Kendall place Maddie refuses to sit in the front seat with David to make sure nothing 'transpires.' After solving the case they are both in the front seat again. They discuss how it's OK that Margaret and Robert are together, but they are not because it would be 'telecide' and they'd be moved to Sunday nights. They admit to being glad "what happened happened," because was pleasurable and it will deepen their friendship but glad it won't happen again. Then David asks Maddie if everything was 'safe' because the last few days were "quite a clambake" but he didn't come "dressed for the party." She assures him that everything was safe. They lose control again and end up reclining the seats back.

Chris's Obsessive Analysis

Maddie freaks out. She has no idea what to do about this and doesn't understand why she keeps letting it happen. She's still in denial about her feelings for David. The pact nonsense was actually foreshadowed in "Witness for the Execution" when they both denied their first kiss happened. David doesn't understand why she is so upset because he's happier than he's ever been. But he agrees to the pact to make her happy (as he usually does.) I think it's really manipulative of Maddie to tell David that if he loves her he'll agree to the pact (it's OK we can forgive her, she's about to have a nervous breakdown.) He does go along with it to prove that he loves her.
In a way this case reflects what is going on with Maddie and David. Maddie is like Margaret a wealthy, naive, "gilded canary" (as David called her) and in love but there are reservations about her relationship because of status. David is like Robert, a regular guy, they've even both been bartenders, previously married, truly in love.
