 BOATS AND BOATING 

[Adopted by the Board of Selectmen 5-3-1949. Amendments noted where applicable.]

Boats — See Ch. 75.

Registration required. 

No person shall operate, run or drive any boat, canoe or any type of water vehicle, propelled by steam, naptha, gasoline, electric, or any motor or engine on or in the South Pond, Middle Pond or North Pond of Congamond Lakes unless he shall have first registered said boat, canoe or water vehicle with the Town Clerk of the Town of Southwick.

Application requirements. 

Upon registering said boat, canoe or other water vehicle, the person applying for said registration shall state on his application the type of boat, canoe or water vehicle and the horsepower thereof, the name and address of the true owner, and the place of docking.

Issuance and display of registration certificate. 

The Town Clerk shall issue to such person, upon the receipt of said application properly filled out and properly approved, and upon the payment of the registration fee of $3.00, a registration certificate upon which shall be printed a number. The person receiving said registration certificate shall paint or otherwise cause to be placed on each side of the bow of said boat, canoe or water vehicle a duplicate of the number issued to him and so stated on said registration certificate, at least eight inches high in a conspicuous place, so as to be easily read.

Period of validity of registration. 

Said registration shall be valid only for the calendar year in which it is issued.

Right of way. 

Row boats, canoes and sailing boats shall have the right of way at all times in any part of the South Pond, Middle Pond or North Pond of Congamond Lakes.

Reckless operation prohibited. 

No person shall operate or drive any such boat, canoe or water vehicle, or any power driven boat in any part of the South Pond, Middle Pond or North Pond of Congamond Lakes recklessly or negligently so that the lives and safety of the public might be endangered or to annoy others.

Restrictions on passing under roadways. 

All operators of said power driven boats intending to pass under the roadways leading from one pond to another, upon approaching such roadway underpass, shall shut off the motors thereof a distance of not less than 50 feet from said underpass and shall come to a stop before entering the underpass and shall not resume power until they have passed through said underpass a distance of not less than 50 feet, except that north of the underpass between the Middle and North Ponds the distance shall be 150 feet.

Registered owner responsible for violations. 

If any boat, canoe or water vehicle violates any of these rules and regulations and the identity of the operator cannot be determined, the owner or the person in whose name such boat, canoe or water vehicle is registered shall be held prima facie responsible for such violation.

Violations and penalties. 

Any person convicted of any rule or regulation as stated in these Rules and Regulations shall be punished by the revocation of the registration certificate or by a fine not exceeding $20.00, or both, for such offense.

Enforcement. 

These Rules and Regulations shall be enforced by any authorized police officer.

Severability. 

These rules and regulations are adopted with the intent that each of them shall have force and effect separately and independently of each other, except insofar as by express reference or necessary implication any rule or part of any rule is made dependent upon another rule or part thereof.
