Please mark your calendar and attend Donna Fiala's Town Hall Meeting at 7 pm Thursday March 6 in the Edison College Auditorium on Lely Cultural Blvd.

Donna Fiala is the Collier County Commissioner representing our District No. 1.

She will speak on various subjects and respond to questions from the audience.  One subject that she will talk on is the developing of a Master Plan that will encourage planned growth along the US 41 corridor.

Donna has strongly supported the Eagle Creek community over the years.  It was through her efforts that Eagle Creek was able to successfully resolved issues resulting from the developments of Wal-Mart and Lowe's.  On your drive to the Town Hall Meeting, you will pass the 30,000 sq ft South Regional Library that is being built on Lely Cultural Blvd, which Donna help make possible by insisting that money for the project be kept in the Collier County budget.  Also adjacent to the library is the Collier County Emergency Operations Center, that is being built.  Both projects will be completed in the summer and fall of 2008.  When you turn onto Lely Cultural Blvd from CR 951, you will also see the Physicians Regional Medical Center Hospital, that she encouraged to be located within our community.

On November 13, 2007, the Collier County Commissioners approved a Developer's Contribution Agreement, sponsored by a consortium of nine developers, which provides funds for improvements to the intersection US 41/CR 951 and the adjoining road two miles east on US 41.  This agreement allows the nine developers to proceed with their projects, beginning over the next 3 to 4 years.  All of these developments by the nine developers are within the vicinity of Eagle Creek.  The Town Hall Meeting is an opportunity for everyone to be informed on what is happening within our community and what is planned for the future.

I hope to see you at the Town Hall Meeting

Here I am again.  The other day, as I was driving down to Marco Island, the thought came to me that Eagle Creek is only approximately 350 to 370 acres with 110 used for The Golf course, 40 acres for the preserve and the rest for housing and Club Facilities.

So when I think of Fiddlers Creek and if I lived there I could have a 20 minute drive in and out from my house.  I can have the same 20 minute drive here if I stop and visit with all the people I know who are out and about here at Eagle Creek.

Friendship is the greatest gift that we have on our Little Island surrounded by large corporate developments.  Then I thought how many friends I would pass on the way to my house just because our size compared to these giant developments. Think of the competition for tee times, diner reservation, and tennis.  Sure we struggle a little for these things here but our caring staff is always trying to accommodate all our requests.

You all know that I am pro Eagle Creek and that I have trust in our board of governors.  I don’t think that anyone of them is out to put it to the members and I am sure that if one of them were the others governors would shut them down.

I never dreamed that my retirement would be in such a great place, my territory is expanding all the time.  The only reasons for this are our governors that take on the responsibility to maintain and govern this little island among the Giant Developments.  Each one of them brings to the table their expertise of all the years of experience.  They work hard and long for the benefit of the membership. We never know all the true facts and we have to remember that the people that step and show up make the decisions.

The next time you have an expectation that isn’t met ask your self is this good for our club and is it really that bad for me.

We all have our expectation of what EC should be and mine is that it has to remain a distinct island in Naples where all the amenities are for the development of deep friendships that we now have the time to enjoy.

Our time is limited and I’m going to enjoy to the fullest every minute and every encounter that life presents me.

So the deeper question is: Why are we here?  What do we want?  How are we going to achieve that goal?

That’s why I started Creekchat to give EC a forum to discuss these issues in open dialog and post information.  It doesn’t seem to be happening.

So if you have a recommendation to improve the Eagle Creek experience or want to bring up an issue, post them here at Creekchat

God Bless

Dennis Farley

Kudos to our chef and all who  created Thursday night's fine dining experience!  The Mediterranean Buffet's four stations had delectable food that was well-presented.  It was definitely a "winner"!  Unfortunately, many of our members missed this event.   Maybe next time???

Fellow Homeowners,

I would like to second Mr.Chirikas recent postings and encourage everyone to attend the upcoming Homeowners' Association meeting on February 18.  Just so you know, the Homeowners' Board has been working for the past several months to re-write the Association Covenants and Bylaws.  The intent of the meeting on Monday is for them to review these with the intention of voting later in the week to adopt the new Bylaws.  Please note the following about the new bylaws:

1.  They can be adopted with a 60% vote of just the Board members, the homeowners will NOT vote on the adoption of the BYlaws;

2.  The Bylaws, as currently proposed, allow the Board to BORROW unlimited amounts of money in the name of the Hoemowners' Association....WITHOUT A VOTE BY THE HOMEOWNERS.

3.  The Bylaws, as currently propsed, will allow the Board to levy assessments AT ANY TIME and FOR ANY AMOUNT they see fit WITHOUT A VOTE OF THE MEMBERS.

4.  The Bylaws, as currently proposed, have NO CHECKS or BALANCES or CONTROLS on BORROWING, SPENDING, ASSESSMENTS or any other financial responsibility.

This, my friends, is a recipe for disaster.  You must go to the meeting, contact your representative, or do anything else you can to STOP these bylaws from being railroaded through.   Just look at the front gate fiasco, which was done BEFORE the new bylaws.  Now, project what can be done with the new bylaws.

Monday, February 11, 2008 4:11 PM  (Three email messages below posted by John Chirikas)

Subject: Formal request for postponement of bylaws vote by the Eagle Creek Community Association Inc. Board of Directors

Dear Board Members,

Please consider this e-mail a formal request by me, John Chirikas, a member in good standing of Eagle Creek Country Club, for postponement of the scheduled vote for ratification of the proposed bylaws until properly introduced to all members of Eagle Creek Country Club via mail, included with definitions of each suggested rule or regulation and accompanied by the opposing Minority Position as posted by Ms. Michele Jones, a member of the bylaws committee. Additionally, I am requesting the Board to formerly present to the membership a proposal that ratification of these bylaws be removed from the Association Board of Directors and instead be voted on by all Eagle Creek constituents. There are many facets of the proposed bylaws which pose financial and personal risk to all members of the community, and the right for the approval of these should be shared, and voted on, by all affected.

The Board has scheduled approval for the ratification of these bylaws on Monday, February 18th and although I believe the open meeting should proceed as scheduled to allow a review of the proposals by all who may be present, it is only proper and fitting that documents of this nature are clearly understood by all Eagle Creek members, regardless if they may be able to attend the meeting or not.

Sincerely,

John Chirikas

John,

FYI, the meeting on the 18th of February is an informational meeting only;  it is an opportunity for the members of the community to ask questions about the proposed Bylaws and Articles of Incorporation.

The next Board of Director's meeting is February 19th at 9:00 A.M.

Thank you Ann. I received this information from Jim Lackey as well and although the voting meeting is scheduled for the following morning, I believe my request for postponement and review should still be honored for the same reasons as stated in my original e-mail. Please formerly proceed with this request.

Thank you,

John

(Following is a letter from Jeff Felton to Jim Lackey, posted at the request of Jeff Felton.   DF)

Jim,

I have not seen the new proposed homeowner Bylaws, and from what I hear I never will until they are passed.  I do not know who my representative is on the homeowners' board, but I trust if it is not you, you will forward this to that person and hopefully to ALL board members.

I would like you to know that I STRONGLY disagree with (1) any bylaw changes not voted on the homeowners as a group; (2) any language which allows the board to borrow any amount of money without a vote of the homeowners and (3) any provisions for assessing the members any material amount without a vote of the homeowners.

Jim, when we lived there and I knew you better, I actually thought you and I came down on the same side of these types of issues as they applied to the club Board of Governors.  It now seems to me that the homeowners board, which has already created a major flap with the front entrance project fiasco, is heading in the WRONG direction vis a vis the wishes of most of the homeowners.

Please Jim take my views as well as those of others to heart when you vote on the bylaws.and please pass this note on the rest of the board members for me.

Hope all is well with you and Sally.

Jeff.

Perhaps the best kept secret of the Bill Owens Classic is the opportunity that awaits you at hole #12.

For a few years now, Carrabba's restaurant has been sponsoring prizes on this hole. This year, being within 10 feet of the pin earned a nice prize and participation in a drawing for a fantastic prize.

With a lucky shot (I'm usually in the front bunker), I won the nice prize, dinner for two at Carrabba's.

And with even more luck I won the drawing for the fantastic prize, dinner for ten served at home.

Last Thursday, Yvonne Lux, the proprietor of our local Carrabba's, arrived with two of her staff and the makings of a marvelous meal.  They brought wine, appetizers, salad, entrees, and dessert.  Yvonne prepared the meal and her guys waited table.  It was a unique dining experience.

So next year, assuming that Carrabba's will be there, forget about gross and net.  Concentrate on hole #12, that's where the big prize is.

The Education Foundation of Collier County needs volunteer mentors for Manatee Middle School students, who qualify for the Take Stock in Children state-wide program.

Take Stock in Children is a program that positively changes the lives of children by providing them with the opportunity to get a college education, the discipline to earn it and the advice and counsel to help them succeed. Economically disadvantaged students who are selected to be part of the Take Stock in Children program are paired up with an adult mentor in 7th grade to help them prepare for success.  Upon successfully completing the program when they graduate from high school, these promising students earn a four-year college tuition scholarship.  In order to successfully complete the program, the students must keep good grades and remain drug and crime free.

Through Take Stock in Children, these students are becoming the first in their family to graduate from high school and attend college.  This program has touched the lives of over 200 Collier County students.  As a volunteer mentor from the community, you can impact the life of a Take Stock in Children scholar in countless ways.  Meeting with a student once each week for an hour at the student’s school, you listen and support a student so they can remain motivated and focused so they can achieve their goals.  A mentor is an invaluable part of the program and a valued friend and advisor.

Some schools such as Manatee Middle School always have a large number of students who qualify for the Take Stock in Children program.  These students are among the most difficult match with a mentor because there are few businesses or organizations in the Manatee area that can provide mentors.  Currently, two male students at Manatee Middle School need mentors. They are bright, articulate and focused and very anxious to start meeting with a mentor.

Help a child discover his or her full potential today and change a life forever. Call Liz Allbritten at 643-4755, or for more information visit  www.educationforcollier.org.

RE:  John & Cathy Chinkas' "Open Letter to Eagle Creek Members" - issued Feb. 4th.

This letter is extremely well written and deserves the thoughtful reflection by all Eagle Creek Members.  It seems that over the years, we, the Members, have lost many of our rights as homeowners because a small group of 'representatives' have decided that they can best operate Eagle Creek without the input and direction of the owners of our homes.  This MUST stop for the well-being of our dear Eagle Creek community.  ALL homeowners should have the right to VOTE on matters that materially effect the value of our homes and the prospective sale of our properties.  This includes the golf/social membership issue, significant landscaping changes and all non-budgeted expenditures of our funds over $10,000.  If the Members do not take control of, and responsibility for, the overall operations of OUR Eagle Creek, it is likely that we are headed for a major disaster in terms of our financial well-being.  Where do we begin?  Please attend the members meeting on Feb.18th from 2-4pm at the clubhouse and defend your rights as property owners at Eagle Creek.  Also, call, write or visit your 'representatives' and let them know how you feel.  These issues must tower above 'cliques' and 'friendships' if we are to maintain our rights. The proposed 'by-laws' are unacceptable without a vote of the members, and, if passed by the Board, members must 'start over' and remove the 'representatives' and develop and pass new by-laws which will be reflective of the desires of the members and for the overall well-being of the Eagle Creek community. And, it would be good if those who speak their mind are NOT ridiculed or maligned as has happened in some recent meetings.  Let us be respectful of one another - as it used to be here at Eagle Creek - and realize that we all want to make our place in paradise a better place in which to live.

Respectfully submitted,
