Be it remembered that I Hannah C. Johnson in the city of Dayton in the Country of Montgomery and state of Ohio, hereby revoking all former wills by me made do make and publish this my last will and testament in manner following: - That is to say: Item 1st: I also direct that my just debts be paid by executor hereinafter named with cosmament speed. Item 2nd: I also desire that my executor named in this will shall as soon as practiable after my death purchase and have erected on the lot now owned by me in Woodland Cemetery adjoining this city - a suitable monument or tobstone at a cost not to exceed two hundred dollars - unless the same shall have been placed there before my death. Item 3rd: I also request my executor that for the purpose of keeping said lot in good condition and repair together with the monument or tombstone thereon; a fund of one hundred dollars be by my said executor paid over to the Trustees of said Woodland Cemetery Association of Dayton Ohio out of my estate (he taking the reciept for the same) the interest of which shall be applied to the keeping of said lot and monument or tombstone in good condition and repair as above named. Item 4th: I desire that my dewelling house situated on lots numbered two hundred and eleven (211) and two hundred and twelve (212) Wilkinson Street Dayton Ohio together with all its contents lots included remain undisturbed for the sole occupancy and use of my son David E. Johnson and my daughter Emma C. Johnson so long as they may remain together as a family. Provided that they the said David and Emma shall agree to and do pay the amount of money to my said executor necessary and requisite to pay all taxes, Insurance etc. and to keep said property in repair, after the interest in fund to be applied to that purpose shall be exhausted. Which fund is herein after mentioned. But should the house and contents be vacated by the family being broken up - by the marriage or death of either or both of my children David and Emma or from any other cause, and should my son David El Johnson be living and unmarried, then he shall be allowed to select and take sufficent personal property to furnish a room for himself; and the remainder shall be distributed among the other heirs, by direction of my said executor, and where [ ] any of the above named or any other cause said real estate becomes vacant then my said executor shall take possession of the same and offer the same at private sale in such manner and when such terms of credit or otherwise as he may deem for the best interest of all concerned (but until he can effect such sale he may rent said premisies but not so as to prevent a sale by the same) and he is hereby authorized to acknowledge and deliver deed or deeds in fee simple to purchaser or purchasers of the same. Item 5th: I desire that the residue of the money remaing after paying all my debts etc. as named in item first and the amounts required by Items second and third, be by my said executor loaned on good security at interest, which interest shall be applied to the payment of taxes, Insurance and repairs on my real estate as named in item 4, until said interest is exhausted. Item 6th: Whereas I have at different times mad an advancement of money to my son Nathaniel S. Johnson and for which I hold his obligations, I desire that said amounts be deducted from his share in the final distribution of my estate, but should he die before the final distribution thereof, then the share that would have been his shall be distributed among my other children mentioned in item 8th of this will. Item 7th: And whereas my son Charles El Johnson has during my life assisted me in various ways in the management of my afairs without compensation; therefore I give and bequeath to him as recompense for said service the sum of two hundred dollars ($200) to be paid to him in addition to the amount due him on the final distribution of my estate and the legal compensation as executor. Item 8th: The amount derived from the sale of my real estate mentioned in item four, together with that from my personal, mixed and all other sources whatsoever (after deducting therefrom all debts expenses and bequests) shall be divided equally among my children share and share alike - that is John D. Johnson, Charles E. Johnson, David E. Johnson, Lucy H. Kates, and Mamie Turner only heir of Hannah Johnson dced, Cynthia E. Burket, Emma C. Johnson, Nathaniel S. Johnson (less the deductions mentioned in item sixth) and to my grand-daughter Lizzie Johnson daughter of my son Martin J. Johnson, who shall share alike with my children named in lines thirteen fourteen and fifteen of this item less five dollars which be given to her father Martin J. Johnson as his full share of my estate, but there shall first as in the case of my son Nathaniel S. Johnson be deducted from her share in addition to the five dollars given her father all charges that I may have against her for maintenance, clothing, schooling, sickness etc. But should my said granddaughter Lizzie Johnson die before the final distribution of my Estate then the share that would have been hers after the above named deductions have been made and all additional ones of last sickness, funeral expenses and the purchase and erection of a suitable tombstone etc, shall be paid to her brothers and sisters heirs at law of Martin J. Johnson. Item 9th: I nominate and appoint my son Charles E. Johnson to be the executor of this my last will and testament and I further desire that no bond be required of him and that be no appraisement of my estate.

Palmer.1 Lydia Ann Capron died on 3 December 1877.2 She was buried in Oak Hill Cemetery, Woonsocket, Providence, Rhode Island.2
