     Samuel Phillips Prescott Fay was born at Concord, Middlesex County, Massachusetts, on 10 January 1778.1 He was the son of Lucy Prescott.1
      "He was graduated from Harvard College, 1798; appointed Capt. in the U. S. Army, joined the forces under Gen. Hamilton at Oxford, Mass. Later he studied law and opened an office in Cambridge, Mass., where he soon acquired a high reputation. In 1821 he was appointed Judge of Probate for Middlesex County, and discharged the duties of this office until 1856, when he resigned because of ill health. He was a member of the Governor's Council in 1818 and 1819, and a delegate to the Mass. Constitutional Convention in 1820."1
