WILL OF GILBERT CONKLIN (c1766-1835)

Be it remembered that at a Surrogates Court held at the Village of Ballston Spa in and for the county of Saratoga on the eleventh day of May 1835 before John W. Thompson Surrogate of said county William J. Welch executor and Clarinda [CROSBY] Conklin Executrix named in the last will and testament of Gilbert Conklin late of the town of Milton in said county deceased appeared and offered the said will for probate and also made application to have said will proved and recorded as a will of real estate pursuant to chapter sixth title first article first part second of the Revised Statutes of the State of New York and made satisfactory proof to said Surrogate of the due service of a citation to the next of kin of the said deceased citing them to appear at the time and place above mentioned to attend the probate of said will upon Isaac V. Conklin, Lucina Cole wife of Pardon Cole, Charles Conklin, Christian Thompson husband of Catherine Thompson, Nathaniel H. Conklin, Carpenter G. Conklin, Mehitabel Filkins, and upon Anson Brown special guardian to Matthew Conklin, Sarah Conklin, Ralph Conklin, and the heirs of Johannah Dutcher, infants under the ages of twenty one years [Abigail is missing; see second listing below], and also made proof of the due service of a notice that they should apply to said Surrogate at the time and place above mentioned to have said will proved and recorded as a will of real estate on each of the above named persons and upon Anson Brown special guardian to the above named infants, and that said persons are all the heirs at law and next of kin of the said Gilbert Conklin deceased who reside within this State and also made proof that a copy of said citation had been regularly published in the State paper once in each weeks for two weeks successfively agreeably to the order of said court, and that said notice had been regularly published in the same paper once in each weeks for six weeks successively. And the said William and Clarinda having presented to said court a certain instrument in writing bearing date the 19th day of November 1834 purporting to be the last will and testament of the said deceased, the the said William J. Welch being duly sworn by said Surrogate testified that he drew said instrument by the direction of said deceased; that the same was delivered to him by said deceased for safe keeping and that the same had remained in his possession from the time he so received it until he presented it for probate, and thereupon Lewis Northrup and Nathan F. Jeffords being each duly sworn by said Surrogate did together with the said William J. Welch severally depose and say that they knew Gilbert Conklin deceased in his life time, that they saw him subscribe said instrument at the end of the same that such subscription was made in the presence of each of them the said Wiliam Lewis and Nathan, that said deceased at the time of making such subscription declared said instrument to be his last will and testament that they the said William Lewis and Nathan respectively subscribed their names at the end of said instrument as attesting sitnesses to the execution thereof, at the request of the said deceased, and in his presence and in the presence of each other, and that the said deaceased at the time of making said subscription was upwards of twenty one years of age, that he appeared to be of sound mind and memory and that he was under no restraint. And the said Surrogate having enquired particularly into the facts and circumstances and being satisfied of the genuineness and validity of said will hereby admits the same to probate, and it appearing upon the proof so taken that said will was duly executed that the said testator at the time of executing the same was in all respects competent to devise real estate, and not under restraint, the said Surrogate hereby allows the same to be recorded as a will of Real Estate pursuant to the provisions of the aforesaid Revised Statutes, which said last will and testament is in the words and figures following to wit -
"In the name of God Amen. I Gilbert Conklin of Milton county of Saratoga nad State of New York being weak in body but of strong mind and memory do make publish and determine this my last will and testament. My spiritual concerns I trust in God to determine. My estate both real and personal I bequeath all to my beloved wife Clarinda and my son Mathew to be by them disposed of in the following manner vis. to pay my honest debts and pay to each of my hereinafter named children one dollar namely, to Mehetibel Mercy Charles Carpenter Johanna [had died 1831] Catherine Hull Abigal Isaac and Lucina children of my first wife to each of them one dollar to pay to my daughterSarah daughter of my present wife when she shall arive at the age of eighteen years, one cow one feather bed and a change of beding and sixteen dollars in money and also to provide and comfortably support my son Ralph during his natural life as he shall be otherwise provided for, the residue of my estate both real and personal as above I bequeath to my beloved wife Clarinda and my son Mathew to be by them enjoyed in common so long as they may live and the said Clarinda remeans my wife, and if she should marry or deceas then all said estate to belong to my son Mathew. And further I do hereby appoint my said wife Clarinda and my son Mathew by his guardian Wm. J. Welch who is hereby appointed and mutually chosen to be executors of this my last will and testament subscribed to and Sealed with my seal done this nineteenth day of November in the eyar of our Lord one thousand eight hundred and thirty four."

I John W. THompson Surrogate of the county of Saratoga do hereby certify that the foregoing is a true record of the last will and testament of Gilbert Conklin deceased and of the proofs and examinations in relation to the execution of the same taken before meon the 11th day of May 1835.
