Prohibitionist

So upon reading, and finding out the current machine used in Florida can give a false positive by up to as much as .070 for eating a slice of bread. This determined through scientific test conducted by an Attorney in Alabama.

That they also can not tell the differences between ethanol, tuelin, gasoline, and 120 substances found naturally in the mouth, that these machines tendency to give inaccurate readings to the point it denys me my God given constitutional right to drink a drink as a free man.

That the Machine in an of itself is creating a situation that places I and many others in a situation where one drink is enough to go to jail for, and currently organizations

are pushing for stricter levels of .050 and .020 which would indeed make any form of drinking and driving illegal. No more glasses of wine with friends. No beer after work before you go home. In effect enforcing a prohibition of sorts upon Americans who have no wish to be prohibited.

"Operating Under the Influence"

"MADD is opposed to the operation of any vehicle while under the influence of alcohol or other drugs. MADD supports legislation that would impose effective sanctions against offenders charged with the crimes of operating or being in actual physical control of any motor vehicle, boat, aircraft, rail or personal recreational motor vehicle while under the influence of alcohol or other drugs."

Does this sound like they mean none? Like they have grouped alcohol into the same group as drugs, and any amount is too much to work any kind of machinery what so ever? Well sure it does, and you'll see they placed it right here on their web page for all to see and believe if they are gullable enough.

Where is the multi billion dollar group with lobbyist in washington for those who just wish to have a drink or two and go home when the time comes. Those who wish to just be left alone from intrusive stops and over zealous police officers who get pay raises according to whether they have been certified on the latest Breathalyzer machine.

One wonders why bars, restaurants, liquor manufactorers are not up in arms screaming and yelling. This current trend is sure to eventually curtail some of their buisness, and at the least some of their sales.

Onto the other unfair unconstitutional aspects. Financial ruination of people who should be free to drink responsibly, and not be held accountable for the actions of others, even though the others in questions actions are heinous in nature, and appaling to all who have morallity as well as compassion. That it is not the actions of a few deviants that should shape our laws. Rather that which is best for the many. Are these current laws good for the many? To one who has stopped after work, had a beer, and some bread products? Now subject to a law that will effect not only this person but his family. I question the law that makes it illegal for me to have a drink, or two. Fordidding a person to drive because they wished to have a few drinks is removing their constitutional right to move freely about this nation. To use highways that their taxes have helped pay for, effectively taxing them without representing them.

The machines in question should be available for further inspection to help bolster the defenses claims as freely as they are used to bolster the states claims. Demanding a test conducted for the jury may help sway a jury very quickly if a bread sampling that gives out a reading of .071 is introduced as evidence possibly could help establish how faulty the machines are. Entering motions of suppression on constitutional grounds open the way for numerous appeals as well as possible retroactive sentence reversals.

And now I would motion we bring said machine forward and test it. Are my rights as an American any less than any other? Am I too not entitled to evidence which may prove my innocence? And what better evidence to bring forward, but the instrument of my accusation.

It is not against the law to be angry. Cynical. Mad. Yet the policeman pulls you over. You act politely. Then before long he wants you doing monkey tricks for friends on the side of the road. Is it any wonder you change moods from polite to belligerent in two shakes. You are civilized. Polite. Respectfull. And uniformed idiots with way too much power are suddenly telling you to do things, and not do things as they see fit. Should you not do tricks to liking, well off to jail you go.

When did America become what it is?
