Projects estimated at over 2 hours require a 50% retainer up front before the work will begin.

If any changes to the specifications are requested after work has begun, the fee will be adjusted accordingly, and the expected delivery date will be adjusted accordingly.

Any requested changes or enhancements that fall out of the scope of the specifications will incur additional costs, which must be paid for 50% up front and the balance upon delivery. This includes changes requested during the project or after the project is completed.

I retain all rights to the software. I sell a license to use the software to you for the purposes intended as listed in the specifications. You don't own the software, nor do you have the right to sell or distribute the software in any way other than what is listed in the specifications.

If you wish to purchase the rights to the software, an additional fee will be charged, with 50% being paid in advance and the balance being paid upon delivery. If you purchase the rights to the software, I reserve the right to use subroutines that are used in the software in other projects, but will not market or resell the software commercially in the form delivered to you.

I cannot be held responsible for errors in the software introduced by the manipulation of the code by you, your employees, or agents.

Software is delivered AS IS. While all possible care will be taken when developing the software to make it work to specification, I am not responsible for circumstances that may arise, including but not limited to: bugs in the operating system or application software; conflicts caused by hardware or other software; the users' ability or inability to use the hardware or software; faulty installation; and any other causes that may interfere with proper usage of the software.

Full payment is expected within 10 days of delivery. If payment is not made in a timely manner on completion of the software, you agree to pay all collection and legal costs incurred by me or my agents in an effort to collect the balance.
