As for my situation, nothing has occurred except threats. On several occasions with the full knowledge that I have an attorney assisting me, they continued to contact me. Two letters from my attorney have never been responded to.
As for my LODs and Incap pay, nothing has occurred.
- I was initially injured 07/26/07.
- FROM THE DATE OF INJURY UP TO THIS DATE, NO DOCTOR HAS EVER CLEARED ME FOR DUTY FROM THE INITIAL INJURIES. On doctor who only saw me for headaches released me for that injury only, and when the problem started up again, she would not see me as I was not on Tricare.
- An incomplete LOD was approved February 2008.
- I requested the company file an appeal, they did not.
- Against medical documentation and with full knowledge of my injuries, I was ordered to a 4 day MUTA which severely aggravated my injuries and causing me to be hospitalized. This created a 2nd LOD.
- I requested legal assistance from the State Headquarters, several times, they never returned my calls.
- Two military doctors and a VA doctor stated I was unfit for duty and my civilian job. I was threatened with arrest for not attending AT even with the medical documentation.
- In July 2008, I was contacted by my unit and they requested a formal statement regarding LOD 2. I provided that statement within a couple days of their request.
- I filed an appeal on my own July 2008 for LOD 1.
- On July 30, 2008, I was contacted by my unit and they requested another statement.
- I advised my unit to contact my attorney and arrange for the statement.
- THE BEGINNING OF AUGUST, I WAS FORMALLY ORDERED BY STATE HEADQUARTERS NOT TO ATTEND ANY MILITARY FUNCTION, DRILL AT, OR ANY MILITARY TRAVEL. This is a LOD issue, as for any treatment at Travis AFB, they are mandated to put me on duty for that day.
- After they were notified I had an attorney the unit contacted me on several occasions demanding I come in and provide a new statement. Each time I referred them to my attorney. They intentionally tried to violate my right to counsel.
- In September, my attorney sent two letters to the unit demanding they reply to his questions, they have not responded to those letters to date.
- I was contacted by the Battalion Commander who again violated my right to counsel. He requested I provide him two documents and that those documents were all that was needed to complete LOD 2. At his direction, I completed those documents and sent them to him. He also stated that I was required to attend drill. I advised him state headquarters ordered me not to. He stated he would look into that.
- My attorney called the Battalion Commander who advise him that JAG would be in contact with him within a couple of days. THIS NEVER OCCURRED.
- IN DECEMBER 2008, THE BRIGADE COMMANDER WROTE MY ATTORNEY STATING I HAD NOT TURNED IN DOCUMENTATION FOR MY LOD AND THAT I WAS BEING CARRIED AS AWOL.
- My attorney contacted the Brigade commander and advise him that I was ordered not to attend any drills, military functions, etc. He also told him to provide a list of documents that were not provided and WE WOULD PROVIDE THE DATE THE DOCUMENTS WERE SUBMITTED.
- To date the Brigade commander has not responded.

Warrior Transition Units’ mission second only to combat, say officials

Getting Soldiers healed from physical, psychological or emotional wounds is an Army mission of highest priority, second only to combat, a senior official said during the Warrior Transition Leadership and Training Conference Jan.13-18.
With the creation of 35 Warrior Transition Units worldwide since mid-2007, more than 8,900 Soldiers, or warriors in transition, are currently assigned and have but one primary responsibility — to heal.
‘‘There has to be a place for these Soldiers to convalesce and heal, and possibly one day return to duty,” said Brig. Gen. Michael S. Tucker, assistant surgeon general for warrior care and transition.
Contacted a SGM at IG's office NGB twice this week. Has not looked into it yet but hasn't fogotten about me. I asked if there is someone to elevate my case to that can fix things. SGM said he didn't know but would look into it. I explained how desperate I am to get resolution and how long this has been going on.
- MEB started Oct 2007---never received orders or reimbursment
- Asked for help to get paperwork to cover me for being out of work or I would be carried AWOL
- Pay was stopped and debt for $20,000, messed up 2007 taxes etc.
- Received draft of outcome June or July 2008
- Had questions about outcome--PEBLO stopped from going to PEB
- Was supposed to get refferrals but didn't until August 2008
- Went to West Point Sept 2008
- Saw Doctor and found out that there were other referrals I was never told about
- File was a mess and Doctor was not happy that I was back since he referred my case to PEB but it was stopped and he was never asked about it
- Needed help getting covered for being out of work but nothing was done so I found out while I was at West Point that I was demoted from E-7 to E-4 because of AWOL
- Discharged, Demoted and Abandoned Sept 2008
- Paperwork still sitting at West Point Jan 1 2009
- (a lot more details exist) This is only an overview but have documentation ready for Lawyer or Attorney that can help
- Had some calls from different people---they are now working on it also. No garuntee outcome will be good but they want to have an outcome. Then it will be up to me to try and fix anything that is still messed up but at least they can say they did what they could and I will be out of their hair also. (sounds like the game of hot potatoe or musical chairs)
- Gov NJ was on live talk show and asked him if he was willing to form a committee to look into the care of sick/injured soldiers in the NG. He mentioned about having one of if not the most aggressive program and continuing to update. Was given a phone number and name to contact and he said he would get on it. 22 JAN 2009.
- My info was forwarded to HRC commander by soldier in California that has not been taken care of
- Nothing resolved, no pay, unable to pay bills, unable to move forward with any rehabilitation and the continued stress continues to make my condition worse.

- Feb 12 2009 Told that contract for extension is not in my records ( Paper work missing ) we have all seen this before
- As I mentioned to someone almost a year ago the process is going through steps and the missing paperwork is just another one of these steps. There are still several to go and the most disgusting of all is still to come---this step will be where they have dragged me through the mud and collapsed my finances to the point of desperation---then they will offer some small amount of money in hopes that we (military personnel will take it and go away.
But they are still working on it
I believe there are not enough personnel to handle the complex case loads at Keller Army Hospital West Point otherwise why would it take over a year to get referrals from doctor.
WOW stimulous plan passed in weeks----but they can't fix my stuff for years--- WTF over.
FEB 13th 2009---Told exception to policy is being made--working on putting me back on orders to complete MEB/PEB and not to contact G-1 HQDA directly. Not exactly sure how my info got there with so many people contacted but told they don't want to deal with soldiers directly. Also asked to hold off fighting for my rights for a couple of weeks. So I will but if anyone wants to continue please do so.
FEB 24 2009 -- Sent message to FOX news & 5th request to Pres. Obama for assistance
FEB 25 2009 -- Still nothing from anyone
March 6 2009-- They are still working on it as the weeks turn in to months and the months to years
Paper work not filed correctly and had to be done over to get me back on orders.
March 24 2009- Another month from my life is gone with no action. I did receive my official bill from Department of defence for $19,000 for the time I was unable to work and the Army medical system and the New Jersey Army National Guard couldn't or wouldn't do anything to help me.
April 06 2009-- Packet resubmitted this past week. Found out New Jersey Army National Guard is not willing to bring me back on active orders to complete medical process but are supposedly going to let me complete it.
Contacted Department of Defence Inspector Generals office.
May 2009--Received info from Maj. Hellrung at Walter Reed that TAG (The Adjutant General) from New Jersey Major General Reith is supposed to make a decision on weather or not NJ will take care of me or not on 13 May 2009.
I am disabled from an injury in the military which has made me unable to work. They abandoned me and took away the very freedoms I fought for. I am looking for anyone that can help me file a complaint with the United Nations. I have been spun around in circles for the past few years and nothing has been taken care of properly. I have been through a congressman and senator and they were told it is being taken care of but the people that are supposidly doing the work are telling me that it is not being done. If you can help please let me know. I will be posting all of the information over time that I can to include all of the names, phone numbers, email addresses, locations and any other information I have or get on all personnel involved since this all started.
Also I was going through a Medical Evaluation at Keller Army Hospital West Point New York. This evaluation started in October of 2007 and I was there again in Sept of 2008 and it has still not been adjudicated. The main person that was supposed to take care of things from the beginning didn't and when he found out that I was out of work said to give him a chance because he was just finding out about it. I told him that I had been trying to get taken care of for over a year. I will add more info later but to get up to date for now the MSG from the New Jersey Air Guard that was in the job was telling people in higher positions things that weren't true and they beleived him. I verified this by playing into his game. I mentioned that I had additional records to send to West Point and since he didn't make sure that other paperwork was sent up there he used this as his excuse. He said that things were held up because I hadn't given him the documents he needed. I had already given the documents to West Point so when it was put in writing that I didn't give the documents to him I had all the evidence I needed. Since I couldn't work and was in bad shape I couldn't stand up for myself so they demoted me and discharged me saying that they didn't want to do anything improper and if I wanted benifits I could go to the VA and file a claim ( I will post the emails soon that went back and forth -- also I will be attaching the voice messages that were left in case there is a lawyer or attorney reading this can help me)
When you have or are losing everything start a web site and make them answer for what they haven't done. Someone has to be responsible not just the injured or disabled soldier. So when it gets bad don't get mad --make a web site. Maybe they will all be able to link together some day so everyone can go to the wall of shame easily.
