Providence Township, Bedford Co., PA

Stephen Garlick's real property in Bedford County was located at the junction of Shaffer Creek and Brush Creek on the East-West Providence Township line about a mile South of the Pennsylvania Turnpike between Mench and Gapsville. See 1872 map of Bedford County.  [I have a better map showing Shaffer Creek and Brush Creek I plan to scan and upload.]

WARRANTEES OF LAND IN THE COUNTY OF BEDFORD 1771-1893. Land warrants were the first document issued to a person who wanted to obtain land from the state. A newcomer to Pedford County would usually blaze a section of land by marking trees with an ax.  This was not recognized as a legally binding tract of land, but was generally recognized by his neighbors and not encroached upon.  A land warrant was legally binding and gave the applicant permission to have the land surveyed. When the survey was returned to the state with a fee, a patent was issued to the individual. There can be many years between the issuing of a warrant and the issuing of a patent, and it may not have been issued to the same person. A patent is the equivalent of a deed between the state and an individual. All land transfers after a patent was issued would be by deed. Most deeds (but not all) were recorded in the county courthouse of the county that had jurisdiction at the time the deed was recorded. This may be the current county, but it could also be any of the parent counties for a particular location. Some deeds were never recorded, and some may have been recorded much later than the date of the deed, some more than 100 years later. Copies of the original documents are available through the PA State Archives in Harrisburg. In most cases, the documents do not include the signature of the person warranting the land. Many of the warrants include the year the land was first settled (listed as the date when interest was to start, almost always on March first). This, however, may not be the date the warrantee settled on the land if the land had changed hands before a warrant was applied for. The only grantor's deed to land owned by Stephen and David was in 1839 when David warranted 40 acres of land to his brother, Jacob. There are no other Grantor's or executor's deeds from Stephen, David, Frederick, Adam or Jacob Garlick that I could find on file in Bedford County.
 

May 15, 1794 Land Warrant #253 issued to Stephen Garlick for 200 acres, return 8 Dec 1808 (patent date). The survey indicates a strange shaped piece of land somewhat like a misshaped hour glass, with Shaffer Creek running through the middle of it South to North - assuming Brush creek runs into the Juniata and not the other way around. The map also has a note "Stephen's other land" to the west of the survey with arrows around the survey north and south. Like the letter "C" with Stephen's survey in the middle of the "C". The only neighbor shown on the map is Thos Clark bordering Stephen's property on the east. This is logical since Stephen was surrounded with his own property and adjoining neighbors would not be shown. I had hoped they would be and they would correspond with the 1790 census of Christly Garlick

Property description and text of the Warrant:

Whereas Stephen Garlick of the County of (Bedford missing it must be in the black seal or image) hath requested to take up Two hundred acres of land situate on the waters of Brush Creek adjoining Thomas Clark at the beaver dam thence running up the said creek to the corner of said Thomas Clarks land on the rock then adjoining Samuel Clarks conditional line up the creek to an old path then adjoining John Shavers [Shaffer's] s'd land on the West in Providence Township in the County of Bedford (provided the land is not within the last purchase made of the Indians,) for which he agrees to pay, immediately, into the Office of the Receiver-General, for the use of this state, at the rate of fifty shillings per hundred acres, in gold, silver, paper-money of this state, or certificates; agreeable to an act of Assembly, passed the first day of April, 1784; and to an act passed the third day of April, 1792, entitled "An Act for "the Sale of vacant lands within this commonwealth." Interest to commence from the date hereof, These are, therefore, to authorise and require you to survey, or cause to be surveyed, unto the said Stephen Garlick at the place aforesaid, according to the method of townships appointed, the said quantity of acres, if not already surveyed or appropriated, and to make return thereof into the Secretary's Office, in order for confirmation, for which this shall be your warrant.

In Witness whereof Thomas Mifflin, Governor of the said commonwealth, hath hereunto set his hand, and caused the less seal of the said commonwealth to be affixed, the fifteenth day of May in the year 1794.

Survey C 67 page 1, Bedford County, Surveyed 1 Nov 1808: Stephen Garlick 219 acres with allowance. Ret'd 25 Nov 1808. No 253 Accepted 23 Nov 1808:

Draught of a tract of land situated on Shaffer's Creek in Providence township and County of Bedford including an improvement surveyed the first day of November A.D. 1808 in pursuance of a warrant dated 15th May A.D. 1794 granted to Stephen Garlick for 200 acres of land; containing two hundred and nineteen acres with allowance of six percent. Signed John Anderson, Deputy Surveyor to Samuel Cochran, Esqr., Surveyor-General.

IN TESTIMONY that the above is a copy of the original remaining on file in the Department of Internal Affairs of Pennsylvania, made conformably to an Act of Assembly approved the 16th day of February, 1833, I have hereunto set my Hand and caused the Seal of said Department to be affixed at Harrisburg, this twenty seventh day of October 1904. Signed (unreadable), Secretary of Internal Affairs.

[Note:  North on the above map is pretty much oriented to the top of the page, however, Shaffer Creek should have been drawn less to the northeast and more to the north.]

The survey shows the odd hour-glass shaped piece of land with a creek running through it south to north, but not the east to west Brush Creek.
 

Patent issued to Stephen Garlick 6 November 1808: Patent P63, page 412 PA Archives. Know Ye, that in consideration of the monies paid by Stephen Garlick into the Receiver-general's office of this Commonwealth, at the granting of the Warrant herein after mentioned and of the sum of two (I think) dollars and thirty seven cents now paid by him into the said office, there is granted by the said Commonwealth unto the said Stephen Garlick a certain tract of Land called Mount Garlick situate in Providence township, Bedford County, Beginning at a post thence by other land of Stephen Garlick South seventy six degrees West one hundred sixty six perches to a Chestnut Oak North thirty degrees West sixty three perches to a Gum North ten degrees East forty six perches to a Gum North eighty six degrees West ninety two perches to a Chestnut Oak North twelve degrees East thirty five perches to a Chestnut Oak North forty degrees East one hundred and fifty perches to a White Oak South fifty one degrees East fifty three perches to a Post thence by other land South eleven degrees East sixty two perches to a Gum South fifty three degrees East one hundred and eighty one perches to a White Oak thence by land of Thomas Clark South eleven degrees West eighty six perches to the beginning, containing Two Hundred Nineteen acres and allowance of six percent, for roads, &c. Which said tract was surveyed in pursuance of a Warrant dated 15th May 1794 granted t the said Stephen Garlick with appurtenances. TO HAVE AND HOLD the said tract or parcel of land, with the appurtenances, unto the said Stephen Garlick and his Heirs to the use of him the said Stephen Garlick his Heirs and Assigns forever free and clear of all restrictions and reservations as to Mines, Royalties, Quit-rent or otherwise, accepting and reserving only the fifth part of all Gold and Silver Ore for the use of this Commonwealth, to be delivered at the pit's mouth clear of all charges. IN WITNESS whereof Andrew Ellicott, Secretary of the Land-office of the said Commonwealth, hath hereto set his hand, and the State Seal hath been hereunto affixed the twenty ninth day of November in the year of our Lord one thousand eight hundred and eight and of the Commonwealth the thirty first third.

David's survey is the "C" surrounding the survey I have of Stephen's property with Brush Creek running across the top of the "C". Evidently the first warrant for "Stephen Garlick's other property" was been lost. The survey was probably never made. The note on Stephen's survey "In Testimony that the above is a copy of the original remaining on file . . ." dated 27 Oct 1904. David's neighboring property owners in 1839 were John Shaffer, John Shaffer, Jun'r, Jacob Mowry, Sam'l Clark, Joel Clark, James Bertchell and William Clark (his brother in law) surrounding Stephen Garlick on three sides.
 

Warrant 15 June 1836 to David Garlick,  No. 329 for 350 acres.

The Commonwealth of Pennsylvania, ss. Whereas, David Garlick of the township of (left blank) county of (left blank) hath applied for three hundred and fifty acres of land including an improvement adjoining lands of Saml Clark, Joel Clark and James Burchill on the north, lands of said applicant and Stephen Garlick on the East, William Clark Peter Markle and John Shaffer on the south John Shaffer, Jr. and Jacob Mowry on the west situate in Providence township in the County of Bedford for which he hath paid into the office of the State Treasurer, at the rate of fifty shillings per hundred acres. Interest thereon from __ June 1811 to be paid agreeably to the several Acts of Assembly, in such case made and provided: These are therefore, To authorize and require you to survey, or cause to be surveyed, unto the said David Garlick the quantity of acres by him applied for, at the place aforesaid, f not already surveyed or appropriated, and to make return thereof into the Land Office, for which this shall be your Warrant.

IN WITNESS WHEREOF, Jno Geblant(?), Esq., Secretary of the Land Office, hath hereunto set his hand and affixed the Seal of the said Office, the fifteenth day of June A.D. 1836. To Jn Taylor(?) Esq., Surveyor General. Jno Geblant(?), Secretary Land Office.

Description on the survey of David's "C" shaped parcel:

Situate on Brush Creek in Providence Township Bedford County containing 389 acres 104 perches and allowance of six per cent &c. Survey the 1 Aprile 1837 in pursuance of a warrant dated the 15th June 1836. By Amos McDaniel under direction of Wm Vickroy D.S. Examined the 18th July 1839. Michael Reed D. S., T. Jacob Sallade Esq'r, S. Genl. etc.

The land survey for Stephen in 1794 is still in his name in 1836 even though his will of 1826 divides in into four sections, one for each of his sons. David's property includes the property shown as "Stephen's other property" in 1794 with probably additional acreage and interest from 1811.
 

Patent to David Garlick, Patent Book 24 p. 296, 14 Aug 1839 Accepted 13 Aug 1839. THE COMMONWEALTH OF PENNSYLVANIA, to all to whom these presents shall come, GREETING: KNOW YE That in consideration of the monies paid by David Garlick at the granting of the warrant hereinafter mentioned and of the sum of two dollars and sixty five cents in full now paid by the said David Garlick into the Treasury Office this Commonwealth then is granted by the said Commonwealth unto the said David Garlick a certain Tract of land situate in Providence township, Bedford County.

Beginning at a white oak thence by land of John Shafer Junr North fourteen degrees East one hundred nineteen perches to a fallen pine North twenty degrees East one hundred forty five perches to a white oak West fifty eight degrees East eighty three perches to a corner, thence by land of Jacob Mowry South thirty degrees East three perches and five tenths to a pine. North forty six degrees East one hundred eight perches to a post, thence by land of Samuel Clark. South sixty five degrees East 14 perches to a post South sixty seven degrees East twenty three perches thence South fifty four degrees east sixty eight perches to a pine thence by land of Joel Clark South sixty one degrees East Sixty eight perches to a fallen pine South eighty four degrees East forty two perches to a rock thence by land of James Bertchel South fifty one degrees East forty eight perches to a post. South twenty five degrees East ninety perches to a post in creek. South thirty two degrees West sixty eight perches to stones, thence by land of Stephen Garlick North fifty one degrees West, one hundred ninety one perches to a Gum. North 9 degrees West sixty three perches to a post. North forty nine degrees West sixty three perches to a fallen White Oak. South seventy four degrees East one hundred sixty perches to a post. South twenty one degrees West seven perches to a post, thence by land of William Clark North seventy five degrees West two hundred four perches to a Chestnut oak. South sixty three degrees West thirty three perches to a post, thence by land of John Shafer North eleven degrees East thirteen perches and five tenths to a Oak.. South Seventy four degrees West fifty four perches to a post. South seventeen degrees and an half West thirty seven perches to an Oak. South eighty five degrees West seventy nine perches to a post. South fifteen degrees West seventeen perches and five tenths to a corner. West twenty five perches to the beginning. Containing three hundred eight nine acres one hundred four perches and the allowance.

Which said tract of land now surveyed in pursuance in pursuance [sic duplicate] of a Warrant dated the 15th day of June 1831 granted to the said David Garlick with the appurtenances.

To have and to hold the said tract or parcel of land, with the appurtenances unto the said David Garlick and his heirs t the use of him the said David Garlick his heirs and assigns forever free and clear of all restrictions and reservations as to mines, royalties, quit-rents or otherwise, excepting and reserving only the fifth part of all gold and silver ore, for the use of the Commonwealth, to be delivered at the pit's mouth, clear of all charges.

In Witness whereof, -------- Jr., Secretary of the Land Office of the said Commonwealth, hath hereto set his hand and Seal of the Land Office of Pennsylvania hath been hereunto affixed the fourteenth day of August, in the year of our Lord one thousand eight hundred and thirty nine and the of the Commonwealth the sixty fourth.
