15 Apr 1793 Abstract of [Warranty] Deed from George Smith to Samuel Chalker.  (FHL Film 28572 Vol 3 p. 543.)

Know all men by these presents that I George Smith of New Haven in the County of Addison & State of Vermont or and in consideration of the sum of twenty-two shillings lawful money to me in hand paid by Samuel Chalker of New Haven aforesaid do give grant bargain and sell ... unto him the sd Samuel two and one half acres of land lying in said New Haven on the right of Joel Camp(?) beginning at the northwest corner of said lot thence south upon the line of sd lott five rods thence east a line parallel with the north line eight rods hence to the north line to contain the land aforesaid in the 2nd Division of lotts in sd New Haven...
In witness whereof I have hereunto set my hand & seal this 15th day of April Anno Domini 1793.

27 March 1798 Abstract of [Warranty] Deed from Andrew Barton to Samuel Chalker.  (FHL Film 28572 Vol 3
p. 539.)
Know all men by these presents that I Andrew Barton of New Haven in the County of Addison and
State of Vermont for and in consideration of the sum of Twenty six pounds lawful money to me in
hand paid by Samuel Chalker of sd new haven the receipt whereof I do hereby acknowledge have
given granted bargained sold ... unto the said Samuel his heirs and assigns forever fifty acres of land
being number eleven in the second division on the original right of which I am proprietor in the
Township of New Haven aforesaid and also a certain tract of land bounded as follows beginning
at the northwest corner of said number eleven, thence running east six rods to the bank of Otter
Creek thence southerly on the bank of sd creek sixty eight rods to a stake thence north to the first
mentioned bounds be the same more or less ...

In witness whereof I have hereunto set my hand and seal this twenty-seventh day of March in the
year of our Lord one thousand seven hundred and eighty nine.   Signed and sealed and delivered
in the presence of us [witnesses] Durano Bobunds & Samuel Barnum. /s/ Andrew Barton & seal...

25 Oct 1802: [Trust] Deed and note from Joseph Jaquays to John Hatch for 20 acres. (FHL film 028572, New Haven Deeds Vol 4:280.)  This means there should be a Warranty Deed from John Hatch to Joseph Jaquays as it appears that John Hatch is selling the property to Joseph Jaquays.

Know all men by these presents that I Joseph Jaquays of New Haven in the County of Addison and State of Vermont for the consideration of fifty five dollars and forty seven cents received to my full satisfaction of John Hatch of New Haven in the county and state aforesaid do hereby give grant bargain sell alien convey and confirm unto him the said John Hatch his heirs and assigns forever part of a certain lot of land beginning at the west end of the second division lot of land laid out and drawn to the original right of Timothy Chittenden in the township of New Haven county and state aforesaid twenty acres of _________

To have and to hold the above granted premises with all priviledges and appurtenances thereof to him the said John Hatch his heirs executors administrators and assigns I do hereby covenant to and with the said John to warrant and defend the same against all claims & demands whatever.

In witness whereof I have hereunto set my hand and seal this 25th day of November AD 1802.

Note:
Signed sealed and delivered in presence of us now the contents of the above deed is such that I the said Joseph Jaquays does [sic do] pay a certain note bearing date of November 25, 1802 of the sum of fifty five dollars and forty seven cents the above deed is to be void and no effect otherwise to be in full force and virtue.

The same day, on the following page, John Hatch was a witness to a deed from Joseph Jaquays to David B. Hunt for the east end or, the other half, of the parcel purchased or sold by John Hatch. Town listed on this deed as Waltham.

30 Oct 1802:  Jacob Hatch and Rufus Hatch purchased two tracts of land in Waltham of 50 acres each from Jacob Klum of Vergennes - (1) Warranty Deed from Jacob Klum to John and Rufus Hatch, (2) Trust Deed from John and Rufus Hatch to Jacob Klum, (3) Mortgage and (4) Foreclosure 9 Feb 1806, as follows:  (Format changed for easier reading.)

(1) [Warranty] Deed from Jacob Klum to John Hatch and Rufus Hatch. (FHL Film 0029105 Vol 1 pages 93-94.)

Know all men by these presents that I Jacob Klum of the City of Verginnes in the County of Addison and State of Vermont for and in consideration of the sum of Twelve Hundred Dollars current money of the United States received to my satisfaction of John Hatch of New Haven in the County of Addison aforesaid and Rufus Hatch of Charlotte in the County of Chittenden the receipt whereof I do hereby acknowledge have given granted bargained and sold and by these presents do give grant bargain sell alien convey and confirm unto the said John & Rufus Hatch their heirs and assigns forever the two following described lots or tracts of land (viz.)
First the whole of lot number fifty eight in the second division drawn to the original right of Ebenezer Stevens in New Haven in said County of Addison said land now lying and being in Waltham in the County of Addison aforesaid containing about fifty acres to be the same more or less.
And secondly the following described lots or tracts of land lying and being situate in the Town of Waltham aforesaid (to wit)
Lot Number fifty three in the second division of the right of Eleazer Claghorn formerly in the town of New Haven containing fifty acres be the same more or less.
To have and to hold the above granted and bargained premises with all the privileges and appurtenances thereof thereto belonging to them the said John and Rufus Hatch their heirs and assigns to them and their own proper use benefit and behoof forever.

And I the said Jacob Klum do for myself my heirs executor and administrator covenant to and with the said John & Rufus Hatch their heirs executors and administrators and assigns that until the insealing of these presents I am well seized of the premises in fee simple that I have good right and lawful authority to bargain and sell the same in manner and form as is above written that they are free and clear of all incumbrances and that I will warrant and defend the same against all lawful claims and demands of any person or persons whatever.

In Witness whereof I have hereunto set my hand and seal the 30th day of October one thousand eight hundred & two.  Signed, sealed & delivered in the present [sic] of [witnesses] Stephen Harmon and Amos Marsh.  /s/ Jacob Klum.

(2) [Trust] Deed from John and Rufus Hatch to Jacob Klum. (FHL Film 0029105 Vol 1 pages 76, Waltham, Vt. received from Darrell Hatch, January, 2000.)
To all people who these presents shall come Greeting.   Know ye that we John Hatch of New Haven in the County of Addison and Rufus Hatch of Charlotte in the County of Chittenden in the State of Vermont for the consideration of Twelve Hundred Dollars received to our full satisfaction of Jacob Klum of the City of Verginnes in said County of Addison do give grant bequeath and sell and Confirm into the said Jacob Klum the two following described lots or tracts of land viz,
First the whole of Lot Number fifty eight in the Second Division Drawn to the original of Ebenezer Stevens in New Haven in said County of Addison said land now lying and being in Waltham in the County of Addison aforesaid containing about fifty Acres be the same more or less.
And secondly the following described Lot or tract of Land lying and being situate in the town of Waltham aforesaid (to wit)
Lot Number fifty three in the second Division of the Right of Eleazer Claghorn formerly in the Township of New Haven containing fifty Acres be the same more or less.
To have and to hold the above granted premises with the Appurtenances thereof unto him the said Jacob Klum his heires and assigns forever to his and their own proper use benefit and behoof and also we the said John and [Rufus] Hatch do for ourselves and each of our heires executors and administration covenant with the Jacob Klum his heires and assigns that at and untill the insealing these presents we are well seized of the foregoing aforesaid premises as a good and feasible estate in fee simple and have good right to bargain and sell the same in manner and form as above written and that the is free from all incumbrances whatever and furthermore we the said John and Rufus Hatch do by these presents bind ourselves and each of our heirs forever to warrant and defend the above granted and bargained premises to him the said Jacob Klum his heirs and assign against all claims and demand whatever.
In Witness whereof we have hereunto set our hands and seals this thirtieth day of October Anno Domini One Thousand Eight hundred and two.

[P]rovided nevertheless if the said John & Rufus Hatch their heirs executors and administrators too shall well and truely [pay] to the said Jacob Klum his heires executor or administrator a certain note of hand by them the said John and Rufus Hatch well executed dated the Thirtieth Day of October AD One Thousand Eight Hundred and Two for the sum of Twelve Hundred Dollars currant lawful money of the United States according to the tennor thereof then this Deed is to be Void, otherwise to remain in full force and virtue in law

(4) 9 Feb 1806: Foreclosure:  Judgment, court action #106, Addison Co., VT [copy, left side illegible] received from Maureen Bryson.
Jacob Klum vs. John and Rufus Hatch . . . action of ejectment against John Hatch and Rufus Hatch both [Waltham]. . . in said county of Addison

. . . the said Jacob [Klum] appeared by his attorney Robt Boston [and] the said John & Rufus and their attorney E. D. Woodbridge and by direction the said defendants by their said attorney a default is entered. Whereupon it is considered by the court here that the said Jacob [Klum] recover of them John & Rufus [Hatch] the quiet & peaceable possession of the premises in his said [...] described with one cent damages and his costs.

And now the said John & Rufus in Court here by E. D. Woodbridge the [...] inform the court that the said Judgment was rendered against a deed for mortgage heretofore executed by the said John & Rufus to the said Jacob Klum the payment of a certain sum of money therein mentioned. The said John & Rufus therefore move the Court here to ascertain the sum in [...] said mortgage and stay execution and set some time for the said John and Rufus to redeem said land by payment of such sums as shall be found [...] agreeable to the statute in such case made & provided. [...] upon it is ordered and deemed by the Court here that execution on judgment be stayed until the fourteenth day of March in the year of our Lord One Thousand Eight Hundred and Seven. And is further ordered that if the said John & Rufus their heirs executors administrators or assigns shall tender or pay to the Clerk of this County Court for said [County of Addison] the sum of One Thousand Two Hundred and Fifteen Dollars, the sum ascertained by this Court to be due to the said Jacob on [...] together with the costs of this process here taxed at seven dollars [and] Forty six cents amounting in the whole to the sum of One Thousand Two Hundred  Twenty Two [Dollars and] Forty six cents by the said fourteenth day of March Eight Hundred and Seven then the above judgement [...] otherwise execution may issue the thereon in due form of [...] Darius Matthews Clerk.

5 December 1803, [Trust] Deed from John Hatch to Asahel Phippenny and notes. (FHL film 28572 Vol 4:445-6)  There should be a Warranty Deed from Asahel Phippenny to John Hatch to go with this Trust Deed.
Know all men by these presents that I John Hatch of New Haven in the County of Addison & State of Vermont for and in consideration of the sum of one thousand sixty dollars and sixty seven cents current money of the United States received in full to my satisfaction of Asahel Phippenny of New Haven in the county and state aforesaid the receipt whereof I do hereby acknowledge have given granted bargained and sold and by these presents do give grant bargain sell alien convey and confirm unto him the said Asahel Phippenny his heirs and assigns forever that part of a certain tract or parcel containing one hundred and fifty acres lying in said New Haven and in the town of Addison in said county of Addison formerly deeded to said Asahel Phippenny by Enos Cap & since by said Asahel to myself lying within the following lines (viz)
Beginning at a stake and stones the north west corner of the aforesaid tract of land thence running south six degrees & thirty minutes west forty six rods and fifteen links to a stake thence west twenty four degrees south eight rods to the bank of Otter Creek thence up said creek eight rods to an oak tree thence northerly four degrees east eleven rods to a stake thence north six degrees 30 minutes west fourteen rods thence east twenty four rods north to a stake in the east line of said tract of one hundred and fifty acres thence northerly to the north east corner thereof thence westerly in the north line of said tract to the first mentioned bounds containing it is supposed ninety acres be the same more or less.
To have and to hold the above granted and bargained premises with all the priviledges and appurtenances there of and And there unto belonging to him the said Asahel his heirs and assignes to his and their own proper use and benefit and behoof forever and I the said John Hatch do for myself my heirs executors administrators covenant to and with the said Asahel his heirs executors administrators and assigns that at and until the insealing of these presents I am well seized of the premises in fee simple that I have good right and lawful authority to bargain and sell the same in manner and form as is above written that they are free and clear of all incumbrances and that I will warrant and defend the same against all lawful claims and demands of any person or persons what so ever --------

one other two hundred and ninety four dollars and twenty two cents payable in good merchantable cattle by the fifth day of October AD 1805

[P]rovided the said John shall well and truly pay as aforesaid the aforesaid notes of hand according to the tennor of the same then and in that case this deed is to be void and of no effect, otherwise to remain in full force & virtue.

11 June 1822: Quit Claim Deed from Wm Hatch, Grantor to Benj. Bullard, Grantee on property originally purchased by Wm. Hatch from Knight Sprague.  William Hatch, of Canton, County of St. Lawrence, State of New York quit claimed 4 acres and 9 rods in Waltham to Benjamin Bullard.  (To be transcribed) Vol 3 p: 79.  FHL film 0029105, Waltham Deeds.

5 Sep 1797, Town Meeting: Andrew Squire was appointed as an additional committee member to divide New Haven's public lands with that part of New Haven "sat off and called Waltham." (Town Rec NH V1: 103)

28 Feb 1799, Town Meeting: Voted to set off 256 acres to Waltham. (Town Rec NH V1: 114)

3 Mar 1800, Town Meeting: Samuel Chalker voted a fence viewer. (Town Rec NH V1: 118)

25 Sep 1801 to 5 Dec 1801: Town Meeting discussions about those who have small pox and conditions under which vaccinations may be given so as to prevent spreading the disease. (Town Rec NH V1: 133-35)

15 Mar 1802, Town Meeting:: Voted: Stephen Cook, Jonathan Peterson, Ira Mills, Enoch Ashby, John Hatch pound keepers. (Town Rec NH V1: 140)

May 1802: Samuel Chalker was called upon by Moses Pier, Justice of the Peace, to appraise 2 stray horses: 1 on 20 May 1802 $20.00 and 1 on 28 May 1802 $22.00. (Town Rec NH V1: 145)

20 Dec 1802: The subscribers being appointed by Moses Pier, Justice of the Peace, for the County of Addison to appraise an Estray [stray] Mare in the possession of John Hatch of said New Have & do appraise the same at $18.00. Sd mare is sorrel colour about four years old a bunch(?) on all her feet. David B. Hunt, appraiser. Received & recorded this 15th day of January 1803 by Elisha Fuller, Town Clerk. 10 Feb 1803: to the town of New Haven we the subscribers and inhabitants on the premises wish to be organized as a school district beginning at the southwest corner of No. fourteen in the Second division thence east to the eastern end of the Second Division Lotts thence North to the Waltham line the North and west of these lines in New Haven to be one district. New Haven Feb. 10, 1803. Signed by Stephen Rider, Calvin Everts, David B. Hunt, John Hatch, Samuel Chalker, Ethen Tously, Jonathan Lusk, Joseph Jaquays, David Sprague, Enoch Sprague, Daniel N. 25 Oct 1806, Surveyor (when surveying the Waltham Turnpike) noted trees marked "H" near Waltham. (Town Rec NH V1: 37)

2 Mar 1807, Town Meeting: Samuel Chalker voted a hayward. (Town Rec NH V1: 193)

18 Feb 1807, Town Meeting: Voted to spend 450.00 to repair the bridge near Samuel Chalker's in the west part of town. (Town Rec NH V1: 194)

I continued to read New Haven Town Records through 1817, but did not find any further reference to Hatch or Chalker.
 
 

Sunset View Cemetery, Waltham, VT

The Sunset Cemetery sits back off the road on a small hill.  It was once part of the Chalker farm in Waltham.

In the back of the cemetery in a row are:

Warnings Out: There are 2 Volumes of Alden Rollins publication. Vol 1 was pub. in 1995 and covers Northern VT; Vol 2 pub. in 1997 covers Southern Vermont. Warnings were issued to newcomers in town that the town would not support them if they had no money. This warning was given to many people--many turned out to be prominent persons in the community. The main genealogical value of these records is the placement of a family in a geographic location at a point in time.

Some 39,342 people were warned out between 1768 and 1818...

"Warning Out" was a common custom in many states. The town fathers feared that newcomers might become town charges, so all newcomers were automatically warned out. Vt state legislature passed the act in Oct 1801, although the procedure had been in place for many years before, and it was in effect for 38 years. If served such warnings within the first year of their being in the town, they were not able to gain *residency* - meaning all the rights that go with it, voting, holding office, etc. Many people ignored the warning-out and became affluent and influential citizens in their respective towns. Welfare existed back in those days - it just took a different form. People were sheltered, fed, and clothed, but not without some complaining from those who worked so hard for what little they had and had to share. Sometimes, widows would be warned out of town if they did not have any family members to care for them.

Film 28570: Town & Vital Records, New Haven, VT, 1791 to 1822.  Records beginning on 4 Feb 1792 - I read beginning through about 1817. The annual meeting for the town was held early in March (first Tuesday of the month(?). Offices appointed at the meeting were until the next annual meeting was held - generally one year. Attendees of the Town Meetings were freemen or those entitled to vote. Researched March, 2000 (Town Rec NH V1)

Research in Washington County, New York

I received the following from William A. Cormier, Salem Town/Village Historian, May 10, 2000:

(1)  History of Washington County, 1737-1878 by Crisfield Johnson:  "In the section describing the formation of the First Baptist Church in the Hamlet of Shushan in the southern part of Salem, John Hatch is listed as a subscriber of church construction in 1800, $25 toward the building expenses and $30 for pew #24.  Noted in the history is the fact that earliest records of the church were lost."

(2)  Hatches were living in White Creek, Jackson and Greenwich to the south and west of Salem.  (Note:  This is an area of Washington County I have not researched.  I am familiar with the Hatches in Whitehall and Granville and have ruled them out.  Contact me if you want more information on these families.  Kaye.)

(3)  Census and Assessment Rolls:  "I checked the Federal Census of 1790 as you did to find John Hatch, but I did not have the Census of 1800 so I could not check the two John Hatches you say show up on it.  I was able to check the Assessment rolls, Real Estate and Personal Property for 1794 and 1795 and found one John Hatch.

"In 1794 John Hatch was listed for Real Estate at £17 and Personal Property at £ 14, 17 shillings.  In 1795 he was listed for Real Estate at £ 100 and Personal Property at £ 114, 4 shillings.  No John Hatch appeared on later Assessment Rolls."

(4)  The Journals of Dr. Asa Fitch:  "In these historical journals, Dr. Fitch notes on a list of tax sales that a John Hatch, Salem and Cambridge had his property sold at a Sheriff's Sale on July 6, 1802.  This might be a good lead and a record of this sale found in the County Archives."
