Proved Will of Walter Hatch

July 9, 1698

O, God Amen. Into thy hand I commit my soul and body as into the hands of a faithful Creator and my blessed Redeemer. Amen.

I give to my son Samuel Hatch all that lot of land he now lives upon, upland 16 acres, meadow 10 acres is lying between the lands of Thomas Oldham on the North and Magoon on the south and I give him that half share of land I bought of Mr. Thomas Hinckley at Rochester divided or undivided with all the rights, titles and privileges thereunto belonging and I give to my son Samuel Hatch aforesaid the whole share of the freemans meadow I bought of John Hathaway of Taunton lying in Rochester aforesaid and I give him that lot I bought of the said Hammons 50 acres lying in Hammons Hooke and two ____ lots and 10 acres the other 3 acres ___. All the three lots lying in Scituate. And I give to him my share in the Iron Works it being a 16 part with all the rights titles and privileges thereunto belonging. All the above mentioned lands and _____ I give to my eldest son Samual Hatch.

I give to my two sons John Hatch and Israel Hatch all my lands I live upon and the two mills the corn mill and the fulling mill with all my housing and barns, the upland by estimation 260 acres, the meadow land about 20, all these lands, mills and housing lying in Scituate on the East side of the North River between of Thomas Lapham on the North and the land of Thomas Oldham on the South. And I give to them my committee lot at Burnt Plain about 50 or 60 acres and 5 acres of swamp the committee gave to me. And my share of the sawmill pond with that share I bought of one of the Turners as appears by a deed under hand and seal with all my right and interest in the commons of Scituate belonging unto me. And the lands above mentioned to be equally divided between them, the aforesaid John Hatch and Israel Hatch and them two are to pay their mother's dowry and to have a care to provide for Antipas Hatch my son and their brother a comfortable livelyhood in meat, drink and clothing, and to bear the charges about Antipas Hatch and their mother's dowry equally between them. And if my son Joseph Hatch be not settled upon his own or elsewhere at or before my death he is to be an equal partner with John and Israel his brother in charges and profits the full space of four years, and then to be all his brothers' and settle upon his own. The charge is the maintaining his mother and brother Antipas and the housing and fences, the mills and dams. The profit is the mills and fields and meadows with their income and increase, and to have his third part of the profits of the orchard.

I Walter Hatch do give as it followeth: I give to Joseph Hatch my youngest son, all that my great lot at Freetown will all the meadow land lying in it and belonging to it and my 4 lots at Swanzey 16 acres in a lot and two lots of meadow outlying before the fifth lot the other lying in the cover at the west side of Taunton River the meadow two acres and a half an acres in a lot, and all my part of the freemens land as it is to divided on the West side of Taunton River. I Walter Hatch have one share of my own and one share I bought of Josiah Winslow Sen. Of Marshfield, deceased. All those lots and lands above mentioned with their rights, titles, privileges, and appurtenances I give to Joseph Hatch my youngest son, to him and his heirs forever and i give to the aforesaid Joseph Hatch Twenty pound sterling in money towards the building of himself a house and a barn.

I Walter Hatch do give to my daughter Jane Sherman twenty pounds sterling in silver money and a cow.

I Walter Hatch do give to my daughter Bethiah Foord twenty pounds sterling in silver money and a cow.

I Walter Hatch do give and lend to Mary Hatch my wife as followeth. I do give to Mary Hatch my wife five pounds a year so long as she bears my name during the time of her widowhood. And it is to be paid every quarter of the year 25 shillings a quarter. And if she marry and change her name, to leave the things lent to her and to have forty shilling during the time of her natural life all of it to be paid in money or provisions at money's price.

I Walter Hatch do lend to Mary Hatch my wife to bed we lye upon and one boulster and one pillow and one pair of sheets and the least iron pot and one tray and one dish and a spoon and trencher. All those things I lend to her during the time of her widowhood.

It is my will I Walter Hatch, that if any of my sons should die and leave no heirs begotton of his own body that the lands and estates he received of me his father Walter Hatch shall be equally divided to his brothers if living or to their children if the brother be dead, and if he leave a widow she shall have a third part of the rents and profits of the land during the time of her widowhood so long as she bears my son's name. This is my will.

July 15, 1698 The land I bought of my cousin Thomas Hatch lying at Tunk (Taunton) the foresaid Thomas Hatch sold me that my part of the land I bought of him was 3375 acres as appears by a deed under his hand and sal. All this land and lands I Walter Hatch do give to my 4 sons Samuel Hatch, John Hatch, Israel hatch and Joseph Hatch to be equally divided between them 4 with all the rights titles privileges and appurtenances thereunto belonging with the charges and profits thereof.

I Walter Hatch do give to my son John Hatch one yoak of oxen and two cows the two cows he has received already.

And to my son Israel Hatch I give one yoak of oxen and two cows. And to my son Joseph Hatch I give one yoak of oxen and two cows. And I give to my three sons John, Israel and Joseph my carts, plows, chains, axes, saws, hoes, with all the rest of my working tools to be equally divided between them 3, John, Israel and Joseph aforesaid.

And to all my grandchildren that are borne before my death of my own sons and daughters I give to every one of them ten shillings a child to buy every one of them a Bible and to lay out the remainder of the ten shillings apiece in other good books. And the aforesaid then shillings apiece to be paid to the sons when they are twenty one years old and to the daughters when they are eighteen years old.

All the rest of my estate that is not disposed of in this will I give to my 4 sons and two daughters, Samuel, John, Israel, Joseph Hatch and Jane Sherman and Bethiah Foord to be equally divided among them all, that is to say my money cattell, swine, bedding cloth and clothing and my books and my household stuff with all the rest of my moveables and movable estate. I Walter Hatch do make and give them power to be my executors and administrators of this my last will and testament. Two of my sons John Hatch and Israel Hatch them two to pay all my debts and legacies and to receive all my debts and dues due to me Walter hatch.
