Will of Thomas Hatch c. 1670-1751 (son of Thomas Hatch 1628)

In the name of god Amen, the seventh day of February, 1750.

I Thomas Hatch of Scituate in the County of Plimouth in New England yeoman being arived to old age but of perfect Mind and memory thanks be to God therefor calling to mind the Mortallyty of Body & Knowing that it is appointed for all men once to Dye do Make & Ordain this my Last Will & Testement that is to say Principally & first of all I Give & Recommend My Sole into the Hands of God that gave it & My Body to commend to the Earth to be buried in a Decent & Christian manner at ye Descretion of My Executor Whome I Shall Hereafter appoint Nothing Doughting but at the General Resurrection I Shall Receive the Same again by the allmighty Power of God, as Touching Such worldly Estate Wherewith it hath Pleased God to Bless me within this Life. I give Demise & Dispose of the same in manner & form following: Viz:

Imprimis: I give & Bequeath to my Well beloved Wife, besides her right of Dower all that she brought to me when I married her. And also I give to my said wife two good cowes, six sheep, one Mare colt, one Hogg & all the pottery, all the corne & meat that shall be left in ye house after my decease, & also my best bed & furniture, two Meat pails, the brass kittel & skillet, one iron pot, one puter bason & two Poxngess(?), one framel(?) & the great & little spinning wheels. I say I give all ye above mentioned personal property to my said wife & to her heirs forever. Also my will further is that my said Wife shall have the use & improvements of the Chest of Drayers My Round Table & Lignaments, morter & box iron & H___ during her natural life & then to be returned to my son David Hatch.

Item. I give and Bequeath unto My son Hezekiah Hatch his heirs and assigns forever his one Half part of my Ceder(?) swamp lying and being in said Scituate at a place called Black Pond Ceder Swamp. Provided he or they pay unto My Daughter Allatheah Hatch two pounds thirteen shillings & four pence lawfull money of New England within six months after my Decease together with what I have already dun for Him by giving him a deed of trust of My Land.

Item. I give & bequest unto my Son Micall Hatch his heirs and assigns forever the one half part of my Ceder(?) Swamp lying & being in Scituate aforesaid at a place called Black Pond Cedar Swamp to him his heirs and assigns forever provided he or they pay unto My Daughter Zerviah Hatch two pounds, thirteen shillings & four pence within six months after by decease together with what I have allredy past to him by a Deed.

Item. I give unto my son Nehemiah Hatch two shillings & eiaght pence lawfull money of New England to be paid him by my son Hezekiah Hatch out of that part of the Estate that I have given to him within two months after my decease with what I have already given to him heretofore.

Item. I give unto my daughter Allitheah Hatch one bed & boister that I had by my Second Wife and and the one Half of the Putor that came by my first wife together with the two pounds thirteen shillings & fore pence which I have ordered my said son Hezekiah to pay to her.

Item. I give and bequeath unto my daughter Zerviah Hatch all that two pounds & thirteen shillings & fore pence which I have ordered my son Michall to pay her & allso the one half of ye Putor that came by my first wife.

Item. I give and bequeath unto my son David Hatch whom I hereby appoint to be my sole Executor of this My Last Will & Testament. After my just debts and funeraile charges are all paid all the rest of my Estate either real or personal if what kind or nature whatsoever that I have not otherwise disposed of I say I give it to him his heirs, assigns forever and I do hereby Utter by D___ & make void all and every other former Testement & Wills & Legacies & Bequests & Do hereby confirm this & no other to be my Last Will and Testement. In Witness Whereof I have hereunto set my hand and seal the Day and year first above written.

Plimouth: June 28th 1751 this Will being presented by ye Executor for Probate the said David Little, Thomas Pincin, Abijah Clap made oath that they saw said Thomas Hatch sign & seal & him Declare this instrument to be his Last Will & Testament & that they at the same time in his presents subscribed as witnesses and that he was then of sound mind.

Before me, John Cushing, Judge of Probate.

Province of the Massachusetts Bay Plimouth by the Honourable John Cushing, Esq., Judge of the Probate of Wills & for granting Letters of Administration on the Estate of persons deceased haveing goods, chattels, rights or credits in the county of Plimouth within the Province aforesaid. To all unto whome there presents shall come greeting. Know ye that upon the day of ye date hereof before me at Plimouth in ye county aforesd, the Will of Thomas Hatch late of Scituate in the county of Plimouth, yeoman deceased to these presents anneonced was proved approved and allowed who haveing while he lived and at the time of his death goods, chattels, rights or credits in the county aforesaid and the probate of said will and Power of comitting administration of all & singuler the goods chattels rights of the said deceased by vertue thereof appertaining to me the administration of all singuler singuler the goods chattels rights and credits of the said deceased & his Will any manner concerning is hereby commetted unto his son David Hatch of said Scituate Executor in the same will named well & Faithfully to execute the said will & to administer the Estate of the said deceased according thereunto & to make a true & perfect Inventory of all and singuler the goods chattels rights and credits of the said deceased and to exhibit the same into the register of the court of Probate for the county aforesaid a for before the twenty eighth day of September next ensuring and also to render a plain & true accounting of his said administration upon oath within twelve months next coming in Testimoney Whereof I have hereunto set my hand & the seal of the said court of Probate dated at Plimouth the 28th day of June, Annoque Domini 1751. Plimouth: February 15th, 1752, David Hatch, Execur made oath that this inventory contains all the said dec'd Estate so far as he knows & that when he shall know of more, he'l give it in. Tthe said apprizers being also under oath.
