Assumption of Risk/Waiver of Damages/Hold Harmless Agreement
By the act of becoming a member of the Parklawn Sailing
Association, Inc. (paying dues), I assume all risks in
connection with my scheduled use of boats, dinghy, or
related equipment provided to me by the Parklawn Sailing
Association, Inc. The boat provided will be skippered by
me personally, or in the absence of my PSA Qualification,
a PSA qualified skipper designated by me will skipper the
boat during my scheduled period. No other person(s) will
be permitted to skipper the boat unless an emergency exists.
I waive all claims for damages or restitution against the
Parklawn Sailing Association, Inc. and its officers and
members because of personal injury, death, or property
damage sustained by me or my family members, guests, crew,
or by anyone else, in connection with the use of boats,
dinghy, or related equipment provided to me by the Parklawn
Sailing Association. I agree to hold the Parklawn Sailing
Association and its officers and members harmless in the
event of personal injury, death or property damage or loss
resulting directly or indirectly from the use of boats,
dinghy, or related equipment provided to me by the Parklawn
Sailing Association. Furthermore, I waive all claims for
damages or restitution against the Parklawn Sailing
Association, Inc. and its officers and members in the event
that any personal injury, death, or property damage results
in claims for damages or restitution against me, my crew,
or guests. Further, I agree not to permit on board the
sailboats or dinghy anyone who will not similarly abide by
this agreement for themselves and minor children.
I agree to abide by the decision of the Parklawn Sailing
Association, Inc. marine mishap Committee concerning my
financial responsibility for any losses or damages sustained
by boats, dinghy, or related equipment provided to me by the
Parklawn Sailing Association.
I understand and agree to the provisions of this "Assumption
of Risk/Waiver of Damages/Hold Harmless Agreement".
