The State of Oregon, Department of Revenue (Revenue) and the SEIU Local 503, OPEU (Union) hereby agree to authorize release time for the Union's President, Joseph DiNicola (President), beginning November 22, 2004 and ending November 21, 2006.

Nature of Assignment:

According to Article 10, Section 13 of the collective bargaining agreement between the State of Oregon, Department of Administrative Services and SEIU Local 503, OPEU, the Union President shall be give release time from his position for a period not to exceed the term of his office for the performance of Union duties.

Conditions of Agreement Include the Following:

• The President will retain all rights, benefits and privileges of his current position and classification.
  
  
• The President will not change status and remain in his permanent classification. He will be granted any/all salary adjustments for which he is eligible.
  
  
• The President will be able to list the experience gained as part of his qualification on future applications and promotional opportunities.
  
  
• The President shall turn into Revenue each month a timesheet that records all time worked and appropriate leave taken signed by his Union Supervisor. All leave taken that qualifies for family medical leave must be clearly identified. Time missed due to "on-the-job" illness or injury is the responsibility of the Union.
  
  
• The Union shall, within 30 days of payment to the President, reimburse Revenue for payment of salary, benefits, paid leave time, pension, and all other employer related costs. All overtime, comp time earned and travel expenses will be reimbursed by the Union to Revenue.
  
  
• The Union shall indemnify and the Union and President hold Revenue harmless against any and all claims, damages, suits or other forms of liability which may arise out of any action taken or not taken by Revenue for the purpose of complying with this Agreement.
