Terms of Agreement and Conditions of Sale


DragonPass Cats, afterwards known as the seller, agrees to provide the buyer with a kitten pack containing the following items related to this cat/kitten:

Vaccination record

CFA registration paperwork

Food for 3 days

4 generation pedigree

Binder containing care instructions

Favorite blanket or bed

Seller guarantees that:



1. This kitten/cat is in good health and free from any serious genetic defect, and/or parasites at the time of delivery.

2. This kitten/cat may be returned to the seller at any time for any reason. However, the seller is not obligated to return any portion of the purchase price. If the seller deems it proper to refund the purchase price in part or in whole, such funds will not be issued until a 90-day quarantine period is completed along with certification of health from a licensed veterinarian.

3. This kitten/cat is guaranteed against congenital defects for a period of one year. Furthermore, the seller will replace the deceased kitten/cat only if a completed necropsy report, including test results of blood, tissue, etc., and a description of the symptoms supporting the opinion, is provided to the seller. A visual autopsy is not acceptable! The buyer will not be reimbursed for any expenses incurred while the kitten/cat was in the buyer's care. The one year guarantee does not cover conditions stemming from the buyer's neglect, illnesses, or accidents the cat came in contact with while in the buyer's care, including, but not limited to, blood transfusions, vaccination reactions, and death due to surgical procedures. The guarantee does not cover fleas, ear mites or fungus, since these can be acquired in route to your home. Seller takes every precaution to keep kittens/cats free of funguses and parasites. This guarantee is for one year from date of purchase and applies only to the original buyer. To qualify for the guarantee the buyer must keep the cat under the regular care of a veterinarian.

4. This kitten/cat is guaranteed as a breeder. Males who are not breeding by the age of three years or do not have two (2) descended testicles by the age of eight (8) months will be replaced with a kitten of comparable quality when available or two (2) free stud services will be provided if the buyer prefers. Females are guaranteed to produce a litter after breeding with a proven male. If she has not produced a litter by the age of two (2), after having been bred at least three (3) times to a proven male, a female kitten of comparable quality will be provided when available.

Buyer agrees that:

1.
In order to validate this health guarantee, the buyer agrees to have kitten/cat examined by a licensed veterinarian within 72 hours of purchase and to advise seller of the results of the exam. The kitten/cat should be isolated from any other animal in buyers' home until said veterinary exam. Failure to do so may result in voiding heath guarantee. Buyer should be mindful that the stress of re-homing the kitten/cat may result in temporary signs of illness which may include sneezing, runny nose, watery eyes, diarrhea, and/or constipation. Persians are especially susceptible to stress-induced illnesses and fungal infections such as URI (upper-respiratory infection) and ringworm.

2. To help reduce signs of stress, the buyer agrees to feed the kitten/cat the food that it is used to eating, a three-day supply of which is provided in the kitten pack. Should the buyer decided to change the kitten's/cat's food, (s)he agrees to do so gradually. Furthermore, the buyer agrees that to reduce the stress associated with being separated from its familiar surroundings, the kitten/cat will be slowly and patiently introduced to the house and other members of the household.

3. Under no circumstances will this kitten/cat and any offspring be sold, leased, abandoned, or given away to a pet shop, animal shelter, humane society, pound, lab, or research facility. Furthermore, this kitten/cat and offspring will not be euthanized for behavioral problems. Should the buyer decide that (s)he can no longer care for the kitten/cat for any reason, (s)he agrees to surrender the kitten/cat to the seller without refund of purchase price.

4. This kitten/cat will be provided adequate and sanitary indoor facilities, and the kitten/cat will never be allowed to roam freely outdoors. By definition, adequate facilities include, but are not limited to, premium quality cat food, fresh water, clean litter, toys, and human companionship. If at any time this kitten/cat is found to be ill, malnourished, abused, neglected, or unattended outdoors, buyer will surrender kitten/cat unconditionally to seller with no refund of purchase price. Failure to surrender kitten/cat in the aforementioned circumstances will cause the seller to take any and all legal action necessary to remove the kitten/cat from the situation.

5. The buyer agrees to provide this kitten/cat with regularly scheduled check-ups, vaccinations, and dental care from a licensed veterinarian.

6. This kitten/cat will not be declawed.

7. The buyer agrees to notify the seller of any future transfer of ownership of this kitten/cat prior to the transaction's taking place. The seller reserves the right of first refusal.

8. This kitten/cat will not be resold without being spayed or neutered first. Should the buyer decide to remove the kitten/cat from his/her breeding program, buyer agrees to offer the kitten/cat, intact, to the seller for no more than the original purchase price first.

9. This kitten/cat may not be used for stud service or bred to a cat not owned by the buyer without written permission from the seller.

10. This kitten/cat will be shown only in peak physical condition and impeccably groomed.

11. Buyer agrees to register with both CFA and AKC Companion Animal Recovery within 30 days of purchase.

Exclusions and Amendments to this contract:

1. This contract is legally binding to all parties involved in this transaction and is non-transferable to other parties. It is expressly agreed between buyer and seller that this contract is formed and executed in the State of California, County of Sacramento, and shall be interpreted by the laws of the State of California without reference to the rules and regulations of the Cat Fancier's Association or any other registering body. In the event of a dispute between parties of this contract, proper venue shall be in the jurisdiction of the State of California, in the County of Sacramento, only. Should disputes occur regarding this contract, buyer agrees to pay for any and all legal expenses incurred on the part of the seller.

2. Should any portion of this contract be found illegal or unenforceable in a court of law in the state of California, sale to be instituted in same, the remainder of this contract is to remain valid and enforceable.
In as much as the below signed buyer has read and understood the terms and restrictions of the sale and understands that this contract is a legal and binding agreement, enforceable within the confines of the United States and that costs incurred in interstate litigation are within the accepted responsibilities of the buyer, this contract is a legal, effectual, and enforceable document within and by all the boundaries of these United States and Canada.
