1674: In a Cause depending
Between John Allen as Admr to the goods Chattles & Creditts of
Nicholas Solby plaintiffe,
& Stephen Gough Defendant, Mr Gough being not present himselfe, it ordered tht the
action be referred till the next Court.Mr Allen being
sick it is ordered tht all his other actions be
referred till the next Court.(Charles County Court

1674: In a Cause depending betweene John Allen Admr of the
goods Chattles & Creditts
of Nich Solby dec plaintife & stephen Gough Defendant, Stephen Gough was Attached to Answer to John Allen Admr of the goods Chattles & Creddits of Nich Solby late of this County dec of
a plea of trespas on the Case. And whereupon the sd John by Samuell Cressey his Atturney Complaineth against the sd Stephen for tht
whereas the sd Nich did on
the 13th day of July 1673 & from tht time untill the 16th day of the same moneth
attend on him the sd Stephen & administer to him
the sd Stephen
divers parcells of Phisicke
in all amounteinge to the suffie
of three hundred & seaventy pounds of tobaccoe, As by a particular account here in Court by the sd John produced more plainly may appeare,
In Consideracon whereof the sd
Stephen did then assume on himselfe & to the sd Nich did faithfully promise that hee
the sd Stephen
when thereunto required to him the sd Nich the sd sume
of 370th of tobaccoe would well & truely pay, Yett neverthelesse the sd Stephen although often thereunto
required the sd suffle of
three hundred & seaventy pounds of tobaccoe neither to the Nich in
his life time nor to the sd John to whom Administracon of all & singular the goods Chattles & Creditts of the sd Nich was Comitted
since his death hath not paid but doth altogether refuse to pay the same,
whereupon the sd John saith
hee hath lost to the value of 500 lb of tobaccoe & thereupon hee bringeth his suite. And the sd Stephen Gough Defendant (by John Jones
his Atturney) comes & defends the force &
injury &c And saith hee
hath not received the Phisicke within mentioned in mañer & forme as within exprest &c: nor did not Assume The plaintife
wanting proofe to his declaracon,
Thereupon the worshipfull the Comissioners
orders a nonsuite against the plaintife

1677: Thomas Jones, Stephen Goff & Mary his wife
executrix of the agt last Will & Testament of
John Jarbo deceased. Stephen Goff & uxr was attached to
answer unto Thomas Jones in Exr Jno
Jarbo a plea of trespas
upon the case And whereupon the said Thomas Jones by Kenelm
Cheseldyn his Attorny complaineth that whereas the said John Jarbo
in his life time to wit the eighth day of June in the yeare
of Our Lord 1672 Stood indebted unto John England & Thomas Jones the summe of three thousand One hundred flinty three pounds of
tobacco In consideration whereof the said John Jarbo
did assume upon himselfe & to the said Thomas did
faithfully promise that he the said John would pay the same on demand after the
tenth of October next ensueing the eighth day of June
aforesaid to the said John England or to the said Thomas Jones their heirs executrs or admrs & the said
Thomas in fact saith that the said John in his life
time nor the said Mary while she was Sole nor the said Stephen and Mary Since espousalls
executrix of the last will & Testament of the said John hath not paid to
either the said John England or Thomas Jones but the same to pay hitherto &
Still doth deny to pay to the damage of the said Thomas foure
thousand pounds of tobacco & thereupon he bringeth
his suite.And the said Stephen & Mary by Robert Carvile
their Attorny cometh & defend the force &
injury when &c & pray liberty to imparle
hereunto untill the next Court & it is granted
them the same day is given to the said Thomas Jones.Att
which said next Court to wit the sixth day of October Anno
1677 Came the said Thomas Jones by his said Attorny
& offered himselfe against the said Stephen & Mary in the plea
aforesaid but the said Stephen &
Mary came not but made default & the said Thomas Jones did under his hand
acknowledge that there is only One thousand five hundred fifty three pounds of
tobacco the remainder of the debt aforesaid due unto him the said Thomas Jones.
Whereupon it is granted by the Court here that the said Thomas Jones recover
against the estate of the said John Jarbo the summe of One thousand five hundred fifty three pounds of
tobacco the debt aforesaid as also the summe of pound
