GLAD Files Suit Asserting MA Anti-Marriage Ballot Question Is Unconstitutional

Friends,

First I would like to wish all of you a Happy New Year and thank you for all of your support!... I cannot believe that this "temporary communication" for the purpose of updating friends on the MA battle for equal protections, is now going into it 3rd year!

I really am wishing us ALL a happy and SUCCESSFUL new year, were the constant attacks of bigotry are put to an end.  Unfortunately, it is not starting out that way.  Besides the horribly mean spirited effort in MA to rollback all marriage protections for gay couples, there are 9 other states with similar efforts in process!

FAVOR To Ask: Ok, this is non-marriage related, but an issue that is driving me crazy.  The American Family Assc. (AFA), a group containing hundreds of thousands of anti-gay members, is pressuring NBC and its affiliates to drop a new show scheduled to premiere tonight.  "The Book of Daniel" features one of primetime's few openly gay male characters, has a lesbian supporting character and is written by a gay screenwriter.  NBC affiliates are beginning to cave under the pressure and are pulling the show.  PLEASE send a quick email to NBC (viewerservices@msnbc.com) asking them not to cave in to the pressure.

Significant Updates This Week:

GLAD Files Suit Asserting Anti-Marriage Ballot Question Is Unconstitutional
Gay & Lesbian Advocates & Defenders (GLAD) today filed a lawsuit to challenge the Attorney General’s decision that a proposed ballot question that would once again exclude same-sex couples from marriage satisfies the Massachusetts constitution.

GLAD’s lawsuit, Johanna Schulman v. Thomas Reilly, asserts that the state constitution empowers only the legislature to seek to amend the constitution in response to a decision by the Supreme Judicial Court.

MassEquality finds hundreds of people on list of anti-gay marriage petition who claimed they never signed it
Joseph Kennedy of Saugus, a self-described progressive with two close gay family members, got the shock of his life when he received a phone message from MassEquality Jan. 3 telling him that his name appeared on a petition to pass a constitutional amendment to ban same-sex marriage.

I called back MassEquality and I was livid. I am a progressive Democrat. I am very much for equal rights. Keep the state out of the church and out of the bedroom,” said Kennedy, 39. After the Goodridge decision went into effect in 2004 Kennedy even went online and became an officially ordained minister with the Universal Life Church, which performs online quickie ordinations, so he could marry either of his gay family members if they chose to marry.

Gay Marriage Threats In 9 States

Washington-- A new year and new threats against same-sex couples with proposed amendments heading to voters in four states, moves to get amendments on the November ballot in three others, and attempts being made in two others and in Congress.

Voters this year will be asked to approve proposed amendments limiting marriage to opposite sex-couples in Alabama, South Carolina, South Dakota and Tennessee.

Grassroots campaigns are underway in California, Florida and Arizona to force proposed amendments onto the ballot this year.

Federally, a proposed amendment is expected to come to a vote in Congress this year. An attempt last year failed to get enough votes.
