Jerry's email update on the fight for Equal Rights (April 30, 2004)
  

Hi Friends,

Nope I'm not in the news this week :-).  At least not that I know of.  Its actually been pretty quiet for me.  I have however, been able to meet up with long lost friends from school as a result of last week's article by the Patriot Ledger.

All is DEFINITELY not quiet on the marriage front.  Our opponents have now proven that they will try every desperate measure possible to prevent the GLBT community from sharing the protections of civil marriage.  Just this past week, even more actions by our opponents have occurred.  Opponents are STILL trying to block May 17th licenses, and now they are even trying to oust the SJC judges who voted in our favor.  Romney, (Satan himself) now has a record number of GOP legislative candidates for the November election.

Governor Aims to Limit Marriage to Mass. Residents, GLAD Offers Perspective

April 25, 2004 -- In response to news that Governor Romney plans to invoke a previously unused 1913 law to prohibit all non-resident same-sex couples from marrying in Massachusetts, GLAD attorney Mary Bonauto said "Massachusetts has no legal justification at all for catering to discriminatory laws of other states, particularly where it has itself already declared that barring same-sex marriages is unconstitutional." Furthermore, Bonauto explained, "the governor's painting with far too broad a brush in his interpretation." The law says that the state cannot marry an out-of-state couple if their marriage would be "void" in their home state. According to Bonauto, this specific legal language could only apply to a limited number of states based on their current marriage policies.

Local clerks won't alter state rules on marriage: Most vow to adhere to whatever guidelines Romney implements.
Town clerks from Quincy to Carver say they will block out-of-state gay couples from marrying in Massachusetts if that's what the state wishes.

‘‘Whatever the state tells us to do, I'm obligated to do,'' Hanover Town Clerk Robert Shea said last week. ‘‘I have no choice.''

LEDGER VIEW: Legislative meddling
A last-ditch legislative effort to remove the four state supreme court justices who ruled in favor of gay marriage is a reminder why we don't have elected judges in the first place.

Romney sends letters to 49 other states about gay marriage 
Mitt Romney sent a letter to leaders of the 49 other states Thursday, telling them out-of-state gay couples will be barred from getting married in Massachusetts unless officials in those states inform him that same-sex weddings are permitted under their laws. 

In his letter to governors and attorneys general, Romney said it was his interpretation that same-sex marriages are not permitted in any other state. 

Because a 1913 law bars out-of-state couples from marrying in Massachusetts if the marriage would be void in their home state, no out-of-state gay couples will be granted licenses in Massachusetts when same-sex marriage becomes legal here on May 17, Romney said. 

Gay advocates have said that a legal challenge of Romney's interpretation of this law is inevitable.

Romney asks other states' input on marriage law
The attorneys general of Connecticut and Rhode Island yesterday began reviewing their laws to determine if they will honor the marriages of same-sex couples who tie the knot in Massachusetts next month, after Governor Mitt Romney notified the state leaders that he will bar out-of-staters from marrying here unless given an explicit OK.

Love, Marriage, & International Intrigue: A forum on immigration dangers for same-sex binational couples

A panel, including GLAD lawyers, will hold a forum on the law and the risks that marriage will impose on their relationships and on the immigration status of the non-citizen spouse.  Translators will be available for a question and answer session.

The Issue:
Binational same-sex couples cannot solve their immigration problems by getting married.  In fact, getting married could make matters worse.  Many binational same-sex couples mistakenly hope that marrying in Massachusetts after May 17th  will help them resolve immigration problems by allowing the U.S. citizen partner to sponsor the non-citizen partner for citizenship and protect him or her from deportation.  However, the federal Defense of Marriage Act (DOMA) will prevent legally married same-sex couples from receiving any marriage-based immigration benefits.  For more information about immigration click here.
