Consider this, you are shopping in a store, minding your own business when a cop comes up and demands your id. Perplexed you ask what it is about, why does he need to see your id. The cop responds because I said so, looking around and all that you see is this cop and a quiet store, it had been quiet for at least a half hour. Again the cop demands your id, now you are concerned, the cop does not identify why he needs to see your id. Giving up your id to this individual exposes you to access of your personal life (name and address). The cop then says that you are impeding the investigation of a crime but if you give him your id he will tell you what is going on. So you comply, the cop take your id, states your name and walks off towards the back of the store, at this time he is yelling something about you knowing the law and laughing.
When you get to the back you find four cops surrounding your girlfriend who you had just taken to the hospital because of a mental breakdown. She is in tears, the last you had seen her was as she was going to the pharmacy to get a prescription from the ER doctor filled. You still do not have your id back, the cops will not tell you why they are harassing you and your girlfriend. Then they start accusing you of a crime, in our case they accused us of prescription fraud, the crime does not matter, it could have been anything.
The more you deny the crime the more they claim that you did it, they could have accused you of killing Nichole Simpson. Can I prove that I was not there when that event occurred ? No. I am sure that they could find a photograph of someone that looked like me in a rental car. One would say that the case against me was weak, but consider this, I am not rich, I cannot afford to prove I was not there, are you, how much representation can you buy ? They say keep your mouth shut, to do that results in impeding an investigation, to ask why results in your being argumentative - I tried all those.
Incarcerated and charges filed, your name and address are posted in the local newspaper. At one time you were stalked and vandalized, one of the reasons that your girlfriend had her breakdown, again you are exposed. The horrors of the past hit you, will the vandalism start again ? Why did that cop target you, you were not disturbing the peace ? Why didnt his fellow cops inform you what was going on ? Why didnt one of the other officers explain the situation ? What was with the skit, you had submitted for arrest, clasped your hands together to keep your wrists together for cuffing, the cop then instructs you to unclasp your hands, you do so and he jumps back, yells "he is resisting arrest" and they all are screaming at you, just what is with this ? You are tasered three times, maced, assaulted, choked, they try to get your girlfriend to say that you abused her and you think here you are in a CVS store that has cameras all over.
Your girlfriend was released to hitchhike ten miles home, you were incarcerated, your friend finds your girlfriend nearly comatose at home that evening. Your girlfriend spends a week in the hospital where they discover that she is bipolar and suffers from depression. So the court date approaches for your girlfriend and yourself. There were the cameras and your girlfriend remembers some other customers witnessing the assault, she said that an elderly person was threatened and a mother and her little girl were upset about the attack, she remembers hearing the little girl ask her mother if they were going to kill you. Surely the store video will show what had happened.
So you get two attorneys, one for your girlfriend he refers another one for you claiming that they would be team mates in their representation. So you write up the details of the event, scan all the documents onto a CD, pay the attorneys. Before you paid your attorney he explained that you had a right not to provide my Id unless cause was identified, you also mentioned the store cameras. Still expecting the cops to be professionals you think, it was a misunderstanding, you did not assault any officer, you absorbed their assault, maybe you had scared them when you were trying to find out what was going on. On entry into the courthouse you discover that the charges have been separated, your girlfriend goes to one court room, you go to another. The original charges had conspiracy to commit prescription fraud, you both were bound to the same court. You ask your girlfriends attorney, where your attorney was.....where was he ? You ask your girlfriends attorney about the charges and courtrooms being separated, he shrugs and says he does not know. Your girlfriends attorney does get the police report and the first sentence gives you concern, it says that you did not give up your id, that you assaulted them, that you were aggressive. Then you see your attorney, he goes and talks to the cops, comes to you and tells you to plead guilty, that he made a deal with the prosecutor. You mention the store video, the attorney says if you were upset it would go against you, you ask if they reviewed it, they said "no". Then you mention the police report, to this, the attorney responds that "the police lie all the time". Then the attorney leaves to handle their two other cases as you wait, thinking, okay, that store video would have the proof, you work in secure area, this event makes you a criminal now. This attorney's change gives you concern, so you figure that you would take the deal and appeal using the video. So you accept the prosecutors deal, walk into the courtroom and all of a sudden the judge goes on a rant against the prosecutor about making a deal. What was the foundation of this rant, the judge only read the file ? Were you presumed guilty ? Why ?
Your attorney tells you that you could get work release, when you apply they deny it because your "criminal history shows a history of assaultive or sexually abusive behavior". So you try to call your attorney from jail, at that time you discover that your attorney has an answering machine and it does not take the collect calls the only calls you can make. You have your girlfriend and friend call your attorney, their messages get no response. You try to contact the attorney when you get out of jail no response to messages. The next thing you try is to obtain the video of the event from the store, implying liability, the store denies liability and forgets to respond to the request about the video, time passes, several communications and they finally inform you that they will not release the video. You write a letter to both the attorneys and to the Virginia State Bar. The attorneys do not respond to the letters and the Bar says that they do not address strategy grievances but you can hire another one of their members to take action against their other members. Expecting that the the government would be interested in resolving any issues pertaining to their policies or possible misconduct of their law enforcement officers you write to the Mayor and Police Chief - no response. Letters to the Governor results in a response stating that yours is a local issue. Your representative gives you some contacts who in turn never respond - dead ends, issue avoided and discarded. Finding the article where your name and address were posted you write to the newspaper that released this information to the public - no response. What history ? This was your first offense, unless they had put something on your record from the times when you were being stalked and called for help ? Why did your attorney's attitude change ? Why did they separate the charges ? A government that is indifferent to claims of abuse by its enforcers ? A press that is negligent in its duties ?
Then there is one last question you ask. These police officers assaulted you in a store with video throughout, they misstated events on their report, they were not through in their study of the case since they did not call the doctor that prescribed your girlfriends medication at the ER, the change in charges separating the courts, the dismissal by the attorneys, a judge going on a rant about a deal that did not impart a severe enough punishment. Consider the alleged risk of "authorities" committing such abuses in a "free society" with functional oversight. Right or wrong no longer matters when available material is not applied to an issue, that issues you presented were ignored, dismissed with the wink and a nod followed by the phrase "of course you are innocent", "they" always say that. Was it because they knew that you were disposable, irrelevant and not a threat because this is accepted policy and procedure. To those that claim you are guilty you respond "you do not know if I am really guilty", because the "authorities" did not fulfill burden of proof, discarded due process and executed presumption of guilt.
The question to ask now is whether this is a "free society" or a totalitarian regime ? What happened to the oversight, the attorneys, a citizens last functional defense without hostilities, ignored our calls because we were not a threat, the complaint to the Virginia State Bar has no teeth since they changed their policy in 2000 (http://www.vsb.org/profguides/1999/codeprof.html). Then there is the Police Chief and Mayor who ignored your letters claiming police brutality, all they had to do was obtain the video from the CVS store review it and respond. Of course given the avoidance of responsibility in addressing such issues. One questions the diligence of their process even if they did try to maintain the illusion of integrity.
So did you kill Nichole Simpson ? Prove your innocence.....good luck
