I came here through the link "The Give Judges A Choice Project". I have found that judges do have a choice, they selectively hear parts of a case and then render biased judgements.

I also have issue with attorneys, do they choose a losing strategy based on experience with biased courts? In one confrontation with an attorney they claimed that they "had to work here" in the courts. In another confrontation with an attorney I was told that video evidence was irrelevant, that the police lie all the time on their reports and that I would not be believed. Of course I would not be believed if no evidence is obtained. So giving judges a choice is a questionable theme.

Back to the judges, in one case I stood up in an attempt to defend us against an attorney. We heard the attorneys side, it was bad as they had material where we responded to a series of attacks. I stood up to present our evidence, pictures and documents. What ensued was an argument between myself and a judge. It was not about our presentation, it was a judge denying me the opportunity to present - this was a judges choice. Another time with a judge was relayed by my girlfriend, it involved the time that I was assaulted in the CVS pharmacy. We had spent the night in the ER, where my girlfriend had a severe reaction to medication treating her anxiety. By the time the night was over I had been assaulted and incarcerated, my girlfriend charged with prescription fraud. Her attorney had not contacted the ER doctor, treating doctors, therapists or the hospital where she spent a week after the event. She said she tried to explain to the judge that she was in a medically impaired state and does not remember whether she had altered the prescription. The judge said that he had no choice - apparently being caught implies a presumption of guilt regardless of evidence.

Whether judges have choices or not is irrelevant, clients need leverage over their attorneys. The clients need to be able to voice their grievances in a trusted environment. Then maybe attorneys will behave like "performance service professinals" and actually present a case to the courts rather than processing clients. Without consequences there is a niche for predatory practices without censure.

Giving clients leverage over counsel, the attorneys will have incentive to stand up against abusive and biase judges. A cascade would start sweeping the corruption out of the courts.
