Communications with the public

The results of communicating with the public, damage caused...
Occasionally someone leaves the impression that they can/will help, lets start with instructions...

Instructions when one finds themselves in a "situation" they are told to research their prospective counsel before hiring them, to ask around about their quality, "word of mouth" to paraphrase a response from the Virginia State Bar.
Unfortunately not many people that we know have had the experiences we have had: What each of these attorneys have told us is not to talk to anyone about the case that their client must be upfront with their "attorney". As a result the individual is isolated, separated from their assets. Years pass, five years for the divorce, five more for the dog bite injury, friends and acquaintances move on, maintaining employment is risky.

When my girlfriend retained the deserting attorney we had discussed the "abuse of process", his instructions were to wait till after the "dog bite" was settled - five years and a desertion later. Should have heard the laughter on that one, 2000 News Groups....

Then after the 2005 Manassas Police assault and all other avenues had failed to provide solutions I wrote on the Lawyers.com forum. I expected tacticians that could make something of an opportunity, at least a professional conversation - instead, read the responses. I am an ex-Marine and have competed in different theaters, so I do know what to expect from a tactician in a performance environment, what it takes to win a game. From the responses these are not tacticians, all responses represented losers crying about what could not be done, failed bureaucrats whose only skill is to argue and make up excuses, they have already lost for their clients. Maybe arguing interpretation of documents such as the Bible or Law Books is the only niche the Evangelical/Puritans have, which would explain the success of Crusading attorney.

What is interesting is the responses one gets from their search from alleged "professionals" in the business of "strategy" and "legal tactics". I try to present as much detail as possible to establish framework of events, a "real" tactician with a highlighter should be able to establish a framework of tactics and focus from the discussion. As a client I should not be asked the following by a professional "explain to me what legal claim(s) or objective(s) which you are pursuing, or with regard to which you seek redress, and what obstacles attorneys have posed to you with respect to same" - tell me what you can do to achieve redress through legal channels. Asking me what I want done about someone that cost us a decade is the wrong thing to ask - destroy them, the Crusader wanted to destroy us, the deserter cost us five years, wipe them from the face of the Earth.

As alleged "professionals" they should be able to provide what options are available to their client given the circumstances. That last quote came from a legal news group a month after we found out that our attorney deserted. A local attorney that we called that was supposed to address "legal malpractice" told us that too much time had passed for the "dog bite" case and that the Virginia State Bar was going to take all the deserting attorney's assets. I asked them about the "abuse of process" of 1995, that got some laughter.

Eventually all conversations end in silence, avoidance - those implementing this profession are inept in "strategy", their memorization may be great, given the sheltered niche provided by self oversight they do not need any "strategy" to fail their clients.

There are no solutions here, only luck....
