Seeding the Judicial Branch with biased justices did not start with Bush, Virginia tested the effectiveness of justice seeding.
We noticed this in the early 90's, when my girlfriend was getting her divorce. The husband obtained a Christian Brotherhood attorney who used the Bible as their law book - thought the judges were going to have a prayer session. The Crusader used the courts to bypass the Privacy Act, accessing private medical records that excluded the periods in question, skipping co-habitation and a year of stalking and assaults. We found out that my girlfriends third attorney was running for political office as a "Conservative" and the husband's attorney was active with recruiting "Conservative" politicians.

I like the excuse NOT to prosecute the torturers in the CIA, giving them license to bully. Clean that house, teach them a lesson. Teach those that do "Black Ops" that there are consequences to knowingly stepping over the line. There are plenty of others in the chain of command that did not torture, embrace the policies of a rogue leader.

Maybe in the future there may be a need to step over the line, those implementing such tactics must be sure that they are right, that there are consequences if they are wrong. That there is oversight. If they are right and they "save the world by torturing" a "bad guy" they can always be "Pardoned" - but the law and policy as a practice does not condone such activities. A lot of our problems are the result of "law enforcement" and "spies" stepping over the line behind closed doors believing that they are above American policy - nearly said above the law, but then Bush and his cronies were busy rewriting the law.
In Virginia I suspect that the Christian Right has been seeding Lawyers as well as judges.
This means that they will interpret the law based upon their biases, from the lawyers representing the parties to the judges. Consider the recent events where the law was interpreted to make torture legal, consider what these individuals infecting the legal profession are willing to do when less "black and white" issues require that they make a judgment - which way would their flag of whimsy wave. For example my girlfriends husband's attorney ignored his spousal abuse, cross dressing, stalking and assaults all because my girlfriend had an abortion.
