I do not think that our experiences are isolated. I suspect that without voice many clients have had similar experiences, they have no leverage over their representatives. When a client complains they are called names, such as told that they are "stupid", "do not know better", have "sour grapes" or just ignored.
I will take the hit on being "stupid". Does that mean that in America I do not have the right to be competently represented ? How about being assaulted by Manassas Police in front of CVS store cameras - that evidence thing.
In our cases the dysfunction in the system was apparent. The concern are the others that are in the "grey" areas, such as those persecuted for possession which has been identified as illegal. If the authorities were so willing to process us in the manner that they did, what are they doing to the others and why are our prisons so full ?
To give the client leverage over their attorney, with the publication of grievances, maybe they would get competent legal representation ? The "officer of the court" would be forced to behave as one.
There is also the behavioral and educational aspect of those that do "interpret" the law. If one is told that a method is the "only way" or the "best way" in the context of the theater over a period of years, the individual starts to believe that the process is the only functional solution. That all clients have "sour grapes" in the modern context, the service aspect of performance is dismissed and complaints such as ours are ignored. The individual being trained/groomed starts to defend the process and in this manner the process is infected.
I like the 2000 Virginia State Bar change, specifically the loss of Canon's 1, 6, 7 and 9 which I believe would have covered "strategy" complaints. The Bar's failure with our deserting attorney identified that Canon 1 was no longer relevant.
The expectation is that this population can convince the client that they are wrong. Excuse failed strategies as human error at the same time persecuting clients that may have made a human error.
The expectation is that any client that does stand up to them will die off, fall on hard times as a result of cascading events that they had initiated. For example I now have a "crminal record" from the CVS store incident, this affects employment opportunities, in my case how, once identified, the police and law will process me / us.
