Ask Manassas Police Chief Skinner....
The following are my perceptions of the Manassas Cop assault event in the CVS pharmacy on January 12, 2005.
These perceptions could have been refuted or confirmed with the store security video that was never obtained.
- First the Manassas Police officer could not identify the reason for his demand of my id.
- When I asked for the reason he became upset.
- After I provided the id he walked off with it yelling that he had "one that knew the law".
- I found my girlfriend surrounded by cops, she was in tears. We had spent the night in the hospital because the medication, Zoloft she had been given had serious effects, falling down, disorientation and loss of control. She still had the hospital bracelet on.
- I went from cop to cop trying to ascertain why they had approached us and were interrogating my girlfriend - they would not respond.
- After they finally told me what was going on, I tried to explain that my girlfriend was in a medically impaired state and were returning from the hospital. They tried to get my girlfriend to say that I abused her....
- I submitted for arrest by clasping my hands behind my back to keep them together for cuffing, when ordered to release them the officer jumped back and yelled "he is resisting arrest".
I expected that our submitting for arrest would be the end of the event. Since the cop had not identified the reason for our being accosted till much later the situation had gotten out of control. What I did not expect was for the Manassas law enforcement officer Barney Fife, to jump back and yell "he is resisting arrest". I looked up at the cameras and turned around.
- I turned around and was tasered, it had minimal effect so after I pulled the barbs out of my chest. As they were electrocuting me I asked them if they were finished, they shocked me again, so pulled the barbs out of my chest. The look on their faces was unforgettable - it almost made the night. They tasered me two more times.
- Then I was body slammed and hit with his little stick thing. The officer hit me so hard that his little stick flew out of his hand, he turned around and bent over to pick it up, my right hand was next to his gun, he was between me and the other blue gangsters, a crowd barrier (pole on rope) was close also and chemicals were on the shelves - thought about grabbing the gun - or - the pole with rope, kicking him into his buddies, grabbing the alcohol throwing it on them and igniting it - or - wrapping them with the barrier. Instead I looked at his buddies and waited for him to get recomposed - I am too old for this silly junk.
- My head was held so that they could empty a canister of mace in my face. The cop holding me was upset that some got on him.
- Then they knocked me down and hit me when I tried to breathe - at this time I thought it would be funny if they killed me.
- In booking they released my girlfriend to hitchhike ten miles home in a medically impaired state. Some people noticed the hospital bracelet and gave her a ride home. Once home she had a melt down requiring that an ambulance be called that evening. She spent the next week in the hospital.
- Because I was handcuffed and the police car seats did not have enough room for my legs I had to lie down in back. At booking I could not get out of the car, as a result they had to pull me out. During this process I heard them laughing at me, one guard said that they wanted me to do something so that they could get to beat on me too. My pants were pulled off in the process which was worse for them than for me.
- Witnesses were not documented and the store security video was never obtained.
- The case started out as conspiracy to commit prescription fraud but then they separated the charges. As a result no one court heard the complete incident - separate courtrooms. My girlfriend was irrelevant in my police assault charges and her witnessing the assault was immaterial to her "prescription fraud".
- Turned out that the police damaged the retina of my eye, my vision has not been the same since - it took a while for the effects of the mace to wear off.
When my girlfriends attorney,
Mr. Raymond D. Kline handed me the police report in court I was nearly sick and my attorney
Mr. Donald R. Daugherty was no where to be found, multitasking other cases. The police report stated that I had not provided my id and had resisted arrest, both statements would have been shown incorrect by the store video. When I informed
Mr. Donald R. Daugherty of the inaccuracies he told me that it did not matter, that the police lie all the time. Did either of these two attorneys read my outline of the event or the medical records of my girlfriends hospital stay and eye injury - I had provided them with a CD containing scans of the documents and outline.
I expect the video to be compared to the police report item by item.
During/after my incarceration I believed that "double jeopardy" would apply to my situation, the prosecutors deal was survivable. I even considered letting the whole thing drop, accepting that Virginia is a police state, corrupt to the core - until the judge went on her five minute rant.
From jail I tried to call my attorney, found out that I could not, it had to be a collect call and my attorney had an answering machine. I did not want to have a conversation with my attorney in public either.
I figure that CVS has probably destroyed the security video, the reason that they delayed responding to that item in my correspondence was to make sure they did destroy it. The video would have shown that we were not being disruptive and I suspect the pharmacist had a grudge, they may have even altered the document, I do not know since I did not see it. It is possible since we caught them sleeping on another occasion and then they had become rude after we had waited an hour. The doctors would have stated, that my girlfriend had a condition and the situation did not warrant the police being called. During the week stay in the hospital after the event my girlfriend talked to the doctor that had written the prescription, they were unaware of any issue requiring the police when they had talked to the pharmacist and they were upset that the event had occurred.
....and my attorney said that evidence is irrelevant, the police lie all the time and the judge's rant over the prosecutors deal identified that Virginia courts are biased.
If these "authorities" are willing to do this to a couple returning from a hospital what else are they doing and getting away with ?
This experience identifies that things like "due process", "innocent till proven guilty" and evidence are convenient fictions to be discarded on whim - if these concepts were actually followed I would have been provided with the video when I asked my attorney for it, the Mayor or the Police Chief.
- What "Rule of Law" does this country follow ?
- What does Public trust mean?
- How about officer of the court, this term was used by those retained to avoid a "strategy" such as producing evidence to defend their client? They claimed that they had to "work there", this was an odd response given that their purpose was allegedly to represent us and use available evidence to defend our position. In context of the profession and the theater it implies that "effectively" representing a client would black list them, a conclusion would be that Virginia courts are "Kangaroo Courts".
- Is "framing" someone to obtain a conviction, "covering up evidence", "collusion" between the retained "officer of the court", law enforcement and the courts considered acceptable "due process" ?
- If they are willing to cover up a minor incident like ours what are they doing to others?
This is not about a few "bad apples", "bad cops", it is about how the American Judicial System, this society implements and executes its "Rule of Law".
Where is the CVS Pharmacy security video ?
What was accomplished by covering up the event ?
Are Virginia courts Kangaroo Court's?
Did they think they would "get away with it" ?
Guess they did and have.... I am laughing, I did their time and this event provided more material for this site.
The question is how many others have experienced similar events and cover ups ?
They did give me foundation and motivation, we had been trying escape from the corruption of past experience's, the reason for my girlfriends breakdown ....
We know the following:
- That the police are corrupt, that cover up and collusion is the rule not the exception.
- That Virginia attorneys use the volume "strategy" in their representation of clients.
- That the Virginia State Bar an Agency of the Supreme Court of Virginia looks the other way when their members execute "strategies" of fraud and predation.
- That when one approaches counsel that claim to address legal malpractice, these "professionals" provide excuses rather than "strategies" that could be profitable to both parties - consider if my perceptions of the event were correct....
- The pharmacist at the CVS store, called the ER doctor that prescribed the medication, should have known that my girlfriend was being treated for mental disorders. They did not get the store manager, the doctor the pharmacist talked to was unaware of any problem with the medication requiring the police. The charge was conspiracy to commit prescription fraud, allegedly my girlfriend altered the quantity, we do not know, my girlfriend does not remember and I never saw the alleged alteration.
What I do know is that we had caught the pharmacist sleeping on a prior visit, we had awakened them and rather than processing us, they ignored us for over an hour, I had to get to work - maybe they were upset at us for that event.
- CVS ignored my request for a copy of their store security video of the event at first, they did address that I considered them liable for the event, after several months of correspondence and dialog they stated that they would not provide the video - without the video I had nothing to solicit alternate legal counsel.
- The Federal agencies such as the FBI never responded, I contacted the Justice Department also - no response. So as long as the crime does not implicate "law enforcement" or kangaroo courts they may address. Claiming that they do address corruption and not responding identifies that their Civil Rights and Color of Law links are a fraud, a betrayal of the public trust.
