The Virginia State Bar an agency of the Supreme Court of Virginia claims that papers, attendance and payments are the only items of relevance. This is like a teacher in school giving an "A" to any student that happens to show up and turn in their homework. The content of the work or service is irrelevant to this "oversight" institution, in fact it is doing what it can to avoid diligence as noted by its 2000 change. This oversight institution does not address the service that its members are supposed to provide their clients, which is legal strategy.
We have had opposing counsel choose the strategy of lying to the courts, making false statements as to dates and events. Retained counsels chose a "strategy" of silence, claiming that the "courts allow a certain latitude", "professional courtesy", ignoring evidence and dates.
When one is the focus of a crusading attorney who is willing to lie to the court and one has an attorney without incentive to engage one loses to both these "officer's of the court". The attorney failing their client still expects payment and as long as they filed their papers and had attendance they are considered diligent - there is no incentive to execute a competent strategy in Virginia. The opposing counsel wins whatever the court's award and the client becomes a victim. When the client tries to address the failed counsel and the damaged case they are told that they have "sour grapes" and ridiculed. As an additional insult to the client, the silenced party, they discover that the Bar dismisses negligent strategies and that they cannot even post a negative "review" of the counsel that failed them. Rule of Law is tossed out the window and the wounded victim/client is limps away betrayed by those retained and the courts that claim fairness, diligence, innocent till proven guilty and other meaningless platitudes.
