erms & Fees
Projects are billed on an hourly or per-project basis, depending on prior agreement. A deposit of 1/3 to 1/2 of total is required, with the balance payable upon completion of project, due upon receipt of invoice (payable within 30 days of receipt). Payments are non-refundable.

RATES: Standard rates for writing services are $100/hour; editing services are $50/hour. Rush jobs will be billed at double the standard rates.

REVISIONS: Revisions are taken into consideration at the beginning of each project. In a typical project, three rounds of revisions are considered standard. Any revisions beyond that, or a major change in project direction, will require additional fees and renegotiation of contract.

APPROVALS: Client will proofread all materials and indicate in writing that project is approved (email approval is acceptable).

CANCELLATION: Mid-project cancellations require payment of all work done to that point, not to exceed any total amount agreed to for said project.

EXPENSES: Out-of-pocket expenses will be billed on my invoice and are subject to the standard 18% markup to cover related time and costs. I will notify client of expenses greater than $50 or 10% of estimated project cost, whichever is less.

CONFIDENTIALITY: All materials created for client are considered confidential during the creation stage and prior to publication. (See Promotional Use below.)

POTENTIAL CONFLICTS: I agree not to accept clients whose businesses directly compete with each other.

ORIGINALITY: I will not knowingly copy anyone else's work; it is client's responsibility to research whether similar creative exists. In case of likeness or similarity, I do not assume responsibility or any liability for name, slogan, design or wording conflicts.

COPYRIGHT OWNERSHIP: Work paid for in full is to be used by client only for the specific purpose(s) of the assignment. For example, web content could not be used for print advertising, without further compensation.

YOUR WARRANTIES: Client warrants the information provided will not knowingly violate any law or regulations or infringe upon or violate the copyright, trademark, or other proprietary right(s) or confidential information of any third party, or violate any right of privacy. If these representations are untrue or this warranty is breached, client agrees to hold harmless me and any employees and agents, from any and all liability, damages, losses, claims, actions, judgments, and costs, including attorney's fees, arising as a result of infringement upon a third party's rights.

LIABILITY LIMIT: My liability shall be limited to the creative fees paid. I am not liable for any consequential or special damages such as profit losses.

GUARANTEES: Anticipated results are not guaranteed.

SAMPLES: Client agrees to provide one or more samples of each piece, in its most finished form.

PROMOTIONAL USE: I may reproduce and/or present to others any work I have done for client (unless specifically prohibited by a formal nondisclosure agreement). I will not widely present work that has not yet been published, distributed or become common knowledge, unless a reasonable time has passed.

This page is subject to change without notice. The terms posted at the time the work was contracted will apply to that work. In the event of conflict between this page and a signed written agreement, the written agreement shall take precedence.
