Article I - Name
The name of this organization is the San Juan 28 One Design Association.
Article II - Objective of the Class Rules
This is a One Design class. The object of the class shall be to promote level racing, maintaining simplicity of rig and gear within modest limits of acquisition and upkeep and such other activities, as will benefit the members of the class. Further that the bylass and future amendments be governed by the concept of simpicity, modest cost and easy maintenance. Any proposed change must demonstrate a dramatic increase in performance without sacrificing these concepts. These rules are intended to ensure that boats of this class are as nearly alike as possible, where the true test is to determine the skill of the Skipper and crew under uniform rules and specifications.
Article III - Class
The San Juan 28 Association shall consist of San Juan 28 sailboats constructed by Clark Boat Company. All boats shall conform to the rules and specifications set forth in the succeeding paragraphs. The plans and specifications on file with the Clark Boat Company shall be considered as setting forth the official standards.
Article IV - Jurisdiction
- The Association shall have primary jurisdiction over all San Juan 28 class activities. These articles and bylaws shall govern all class races and activities, and are binding on all members and fleets.
- All disputes or issues involving the interpretation of these articles and bylaws shall be submitted in writing to the Governing Board for resolution and the decision of the Governing Board shall be final and binding upon officers, members, and fleets.
- The Association may declare ineligible any yacht which does not conform to the plans and specifications for the San Juan 28, or which fails to conform to the rules and regulations set forth in these articles and bylaws.
- The Association shall not be liable for any debts contracted by its officers or members unless such debts are first authorized by the Commodore and Treasurer of the Association, and are subsequently ratified by the Governing Board.
Article V - Membership
- An Active Member must be an owner or part owner with privileges of holding office and voting.
- An Associate Member is a person, usually a non-owner of a San Juan 28, who joins the fleet because of any interest in the welfare of the class, who may not vote, or hold office.
Article VI - Class Officers
The Class shall elect the following officers at each annual meeting who shall serve until the ensuing annual meeting, or until their successors are elected at a special meeting: Commodore, Vice-Commodore, Secretary-Treasurer, Measurer.
The duties of the Fleet Officers are as follows:
- Commodore - Shall preside over the meetings of the general membership and be cheif executive officer of the Association. The Commodore shall fix the dates of meetings of the general membership and call meetings of the Governing Board. The Commodore shall call any additional meetings as shall be needed. Duties will include approval of annual reports and official actions of other officers; appoint special committees; rule on procedure and jurisdiction; authorize Class expenditures; and perform other functions as may be warranted for the proper management of the Class.
- Vice-Commodore - Shall assist the Commodore.
- Secretary-Treasurer - Shall keep minutes of Class meetings, receive dues and fees, deposit all Association funds, keep financial records, make necessary disbursements, prepare an annual financial statement and budget, and shall perform all other duties as shall be directed to said office. Shall keep the official Class Roster.
- Measurer - Shall grant or reject all measurement and answer questions about measurements rules. Duties pertain to the San Juan 28 as a One Design Class only, not to Handicap rules.
Article VII - Governing Board
The Governing Board shall consist of six members, including the Commodore, Past Commodore, Secretary-Treasurer, Vice-Commodore, and two members selected by open election by the general membership at the annual meeting. In the event of a vacancy on the Governing Board, the Commodore shall select a temporary replacement who shall serve until the next annual or special Association meeting.
The Governing Board shall enforce the Constitution and bylaws, conduct all bisiness, determine Class policy, serve as the last Court of Appeals over constitutional rights, sanction or ban fleet activities, and suspend members guilty of gross violations of the rulesq or of unsportsmanlike conduct for a period not exceeding its term of office.
Article VIII - Dues
Association dues shall be fixed at the annual meeting by the general membership. Dues must be paid before a member can be in good standing. Where a San Juan 28 is owned by more than one person, only one of the owners shall be required to pay the racing fee. The part owner paying such sum shall enjoy all the previleges of active membership. The remaining part owner(s) may, if they wish, be Associate Members.
Dues are payable at the begining of the calendar year, and are collected by the Association Secretary-Treasurer.
Article IX - Meetings
An annual meeting of the general membership shall be held at the end of the racing year.
Article X - Voting
- Governing Board - Four officers of the board shall constitute a quorum, and three affrimative votes shall be required to carry.
- General Membership - 25% of the Active Membership shall constitute quorum. A majority of votes of the Active Membership present shall be required to carry. Members whose dues are in arrears or who are otherwise not in good standing, shall not be entitled to vote. There shall be one vote allowed for each San Juan 28. In case of a tie, the Commodore shall cast the deciding vote. Proxy votes will be allowed.
Article XI - Suspension
Any officer or member may be suspended or expelled by 3/4 vote of the membership.
Article XII - Fleet Charters
- A new fleet may be granted a charter upon application to the Secretary-Treasurer of the Association and approval by the Governing Board. Application shall be made by three or more owners, who must be members of the Association of three or more San Juan 28 sloops, not within the territory of an organized fleet. The Governing Board shall have the authority to designate the geographical area included within each Fleet's territory, and to increase or decrease the area from time to time as may be required for orderly growth and development of the San Juan 28 Class.
- Fleet charters may be suspended by the Governing Board, but can be revoked only by a majority vote of the membership for failure to maintain in good standing a minimum membership, and quota of San Juan 28 sloops as abvove required, or for other adequate cause.
Article XIII - Amendments
The Constitution and bylaws may be amended by a vote of two-thirds of the Active Membership in good standing present at any regular meeting. The Governing Board shall have the power to interpret, simplify or clarify the language of the bylaws, if the intent or purpose remains unchanged.
 
BY-LAWS
 
Article I - Meetings by Mail of Governing Board
- The Commodore shall communicate regularly with the members of the Governing Board and at least once during his term of office, shall provide that body with an opportunity to conduct such business by mail as it may deem appropriate. A majority vote shall decide all issues. At least half of the members of the Governing Board must cast their votes in order for any given ballet issue to be validated.
- The Commodore shall allow no less than two months from the date of his mailing for ballots to be returned, so that Governing Board members shall have the opportunity to discuss the ballot with their Fleet members before casting their votes.
Article II - Fleet Meetings and Reports
- The annual meeting of each Fleet shall be not later than November 30 of each year, and results of the election of Fleet officers shall be filed with the Association not later than December 31.
- The Fleet Secretary shall file with the Association Secretary-Treasurer on or before December 31 of each year, a written report of Fleet activities, events, and developments during the year just ended. The filing of the annual report shall, unless waived by the Governing Board, be a condition precedent to renewal of the Fleet's rights and privileges under its charter.
Article III - Eligibility for Sanctioned Events
- To be eligible to receive any points or award granted by the Association, a Skipper must have paid his Association dues prior to the series of Regatta in which the points or awrds are granted. The "Skipper" is defined for the purposes of this rule as the person at the helm. If he resides within the designated territory of any Fleet, he must also be a member in good standing of a Fleet, though not necessarily the Fleet of his residence, if he customarily sails on the waters of a different Fleet of which he is a member.
- The spouse of an Association member and the member's children who are under the age of 12 years, shall be eligible to act as Skipper of the member's boat without payment of additional dues.
Article IV - Sloop's Number and Class Emblem
- The official number allocated to new sloops by the Clark Boat Company, Regional or racing number, and the San Juan 28 class emblem, shall be affixed to both sides of each mainsail used by San Juan 28 class sloop during its life.
- The Secretary-Treasurer of the Association shall maintain a permanent record of each San Juan 28 class sloop, showing number and ownership.
Article V - Racing Restrictions
- The number of persons allowed in a San Juan 28 sloop in a race shall be two or more, or according to local safety rules, with the maximum of six.
- In San Juan 28 Association sanctioned races, the crew number shall be consistent in all races of the series.
- No hiking straps or similar devices shall be allowed.
- No moveable ballast is allowed, including wet clothing worn as a ballast.
- Skippers in Fleet or Interfleet races, or series, must be members in good standing of the San Juan 28 Class Association, or their family members as described under Article III of these bylaws.
- Trapese type hiking devices are not allowed. Nor are crew members allowed to support themselves with standing or running rigging as a means of balancing the boat.
- Interior Structure and Equipment - May not be altered as to weight, accomodation or structural ability. All equipment shall remain aboard and in its normal location when racing including head, stove, seat hatches, tanks, pumps, etc., including cushions.
SPECIFICATIONS
 
Measurement Rules
It is the intent of the Measurement Rules of the class to insure that boats race and remain as nearly identical as possible within normal building tolerances and to insure and enforce the One Design nature of the class. Accordingly, any equipment or modifications to equipment deemed by the class to contravene either the spirit or the letter of these rules shall be outlawed.
Article I - General
The selection of original fittings, spars, sails and any other equipment furnished with a San Juan 28 sloop at the time of its sale by the manufacturer shall be at the discretion of the Clark Boat Comapny.
Article II - Hull Construction
- All hulls shall be constructed of fiberglass from molds made from "plugs" or forms furnished by the Clark Boat Company, and in accordance with procedures established by the Clark Boat Company, shall be made by builders licensed by the Clark Boat Company and approved by the Executive Committee of the San Juan 28 Class Association, and shall conform to the official specifications.
- The mast step position may not be altered from its original manufacture, and adjustable steps are not permitted. If the step is damaged, or if any change is required to accomodate a new mast, the aft edge of the boltrope groove of the mast must be in the same position when stepped as it was prior to the repair or damage. No rotation of the mast which exceeds the usual mast step slope is allowed.
Article III - Mast and Boom
- The mast shall be made of aluminum.
- Halyards may run outside of the mast or internally.
- Tapered masts are not permitted.
- No midstay tackle other than a standard turnbuckle is permitted.
- Wire halyards are permitted.
- No stays on the mast are permitted, other than four shrouds, forestay, and backstay, and optional midstay.
- Other than the standard turnbuckle arrangement, devices for adjusting the forestay, changing the tension of the shrouds, or otherwise adjusting postion of the mast while under way are not permitted. A backstay choker or any other backstay tensioner is permitted.
- Length of the mast is limited - 701 = 37.75. A one inch black band is to be no higher than 35'-5 1/2" above the mast step. The sail, when hoisted, shall not extend its topmost portion above the lower edge of the band. Another black band must be maintained on the mast 33'-0" from the lower edge of the band to the upper edge of the lower band. The sail shall not be downhauled past the upper edge of the lower band.
- If a mast is replaced, the replacement mast must be identical in all essential respects to the mast then being supplied as original equipment on new San Juan sloops.
- Spreader shall hold shrouds 38" from mast (minimum).
- Boom shall be made of aluminum.
- Length of the boom is not limited. However, a black band one-half inch wide shall be maintained on the boom, the inner edge of which is a distance not greater than 9'-6" from the aft edge of the mast. The sail must not be outhauled past the inner edge of the band.
Article IV - Rigging and Equipment
- Rudder: Must be original equipment
- Tiller or wheel open.
- Hiking aids: A hiking stick or tiller expantion of any design is permitted, but no other hiking aid above deck level is permitted. Hiking straps of any design are not permitted.
- Keel and Ballast: External lead of 3100 pounds from the existing or identical mold shall not be altered in either section, profile, weight or placement. Other interior lead ballast or any unusual placement of gear that would provide the effect of inside ballast is not allowed.
- Jib Sheet: Other than holding the jib sheet by hand, no reaching devices are permitted. The blocks may be attached to a sliding track which provides adjustable positions fore and aft. The blocks may be attached by means of metal fittings or wire to extend the blocks but such extenders shall be so designed and rigged as not to be adjustable during a race.
- Jib Halyard Latch: A winch or other similar devices for tensioning the jib halyard is permitted.
- Spinnaker Pole: The spinnaker pole may be made of any material. Its length shall not exceed 12'-0" measured from end to end. The spinnaker pole must be used and connected to the mast when the boom is carried.
- Whisker Pole: The whisker pole may be made of any material, length , and type. It is to be used only with the jib and must be attached to the mast while in use. It must be used only on the side opposite to that on which the boom is carried.
- Anchor: A suitable anchor, chain, line, paddle, and boarding ladder shall be required. Bunk cushions suppied by the manufacturer or cushions equivalent to them should be on board.
Article V - Sails
- General
- San Juan 28's may carry mainsail, 4 genoas, maximum size 150%, and spinnaker (IOR max), as shown in the sail plan.
- Use of sails other than above shall not be allowed for class racing, except at local option.
- Mainsail
- The mainsail shall attach to the mast and boom by boltrope groove.
- Luff and foot measurements shall be controlled by the black band system.
- Batten length maximum: Per IOR, 2-max 23 1/2", 2-max 25 5/8".
- Battens shall divide the leech diagonally into equal sections with 2" tolerances to allow sailmakers to avoid seams with batten pokckets.
- Hollows between battens in leech not to exceed 3/4" in roach.
- Clark Boat Co. (the Company), as Manufacturer, warrants all boats and parts manufactured by Clark Boat Co. to be free from defects in material and workmanship under normal use and service FOR A PERIOD OF TWELVE (12) MONTHS AFTER THE DATE OF DELIVERY TO THE FIRST USE PURCHASER THEREOF, OR FOR TWENTY-FOUR (24) MONTHS AFTER DELIVERY TO THE ORIGINAL PURCHASING DEALER, WHICHEVER OCCURS FIRST (hereinafter Warranty Period).
- THIS WARRANTY IS EXPRESSLY MADE IN LIEU OF ALL OTHER EXPRESS WARRANTIES, REPRESENTATIONS, CONDITIONS, OBLIGATIONS OR LIABILITIES ON THE PART OF THE COMPANY. ALL IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO THE WARRANTY PERIOD ABOVE DESCRIBED. RELIEF UNDER THIS WARRANTY IS LIMITED TO THE TERMS HEREOF AND THE COMPANY ACCEPTS NO RESPONSIBILITY WITH RESPECT TO INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING FROM A BREACH THEREOF.
- This Warranty shall only apply to the original purchasing dealer or the first use purchaser.
- This Warranty shall apply to all boats, components, or parts manufactured by the Company EXCEPT;
- Paints, varnishes, gelcoats, chrome-plated, anodized aluminum finishes and other surface coatings, because they are affected by climatic and use conditions beyond the control of the manufacturer.
- Any boat or boat part manufacturered by the Company which shall have been altered or repaired at other than duly authorized service facilities, or subject to misuse, misapplication, negligence or accident.
- Items specified in the Owner's Manual as dealer responsibility in launching a new boat.
All engines, pumps, batteries and other boat accesories not manufactured by the Company are NOT covered by this Warranty. However, any warranty furnished by the manufacturer thereof, if possible, will be passed on to the original purchaser.
- ORIGINAL USE PURCHASER'S OBLIGATIONS:   As a condition precedent to securing warranty performance, the original use purchaser must;
- Complete the Warranty Registration Card attached to this Warranty and mail it to the Company at the address shown thereon within 30 days from the date of delivery to the first use purchaser.
- Make any defective part or boat available, at the purchaser's own expense, free and clear of all liens, at the location of an authorized dealer of the Company within the Warranty Period.
- AUTHORIZED DEALER'S OBLIGATION:   As a condition to securing reimbursement od expenses under this Warranty, the authorized dealer must;
- Make a through investigation of the alleged defect and the cause(s) thereof and determine that a defect covered by this Warranty does in fact exist.
- Make a written claim on the Company within 30 days of the date work is commenced by the dealer on repair or removla of a defective component.
- Retain any replaced parts for ultimate inspection by the Company.
- Consult with the Company directly before undertaking any major repairs.
- Within the Warranty Period specified above, the Company will, through its selling dealer, reimburse the purchaser for the labor costs involved in the removal of the defective parts and the reinstallation of repaired or replaced parts, provided that the labor cost reimbursement will be based on a reasonalbe number of hours as determined by the Company. Labor will be paid at the regional labor rate.
If repair or replacement of the defective boat or part is, in the opinion of the Company, not commercially reasonable, the Company may elect to refund the purchase price and take back the product.
- The dealer is not an agent for the Company except for the purpose of administering the above Warranty to the extent herein provided, and the Company does not authorize the dealer or any other person to assume for the Company any liability in connection with such Warranty, or any liability or expense incurred in the replacement or repair of its product other than those expressly authorized herein.
- The Company reserves the right to make changes in design or material in its products without being obligated to incorporate such changes in products of prior manufacture, and to make changes at any time in design, material or parts of boats of any one year's model without obligation or liability to owners of boats of the same year's model of prior manufacture.
- All repairs or replacements under this Warranty shall be performed by the Comapny or its authorized dealer within 60 days of purchaser giving notice of a claim and making the defective part(s) available to paragraph 5 above.
- Since repairs, replacements, etc. under this Warranty are administered through authorized dealers, the Company does not guarantee that Warranty service will be available 9 a.m. to 6 p.m. monday through Saturday. (For information on the location of authorized dealers in your area, consult the Yellow Pages of your telephone directory.)
- This Warranty gives you specific legal rights. In the event of a problem with Warranty service or performance, you may be able to go to a small claims court, a State court, or a Federal district court.
